I got in a car accident. The hospital bills were all paid by insurance- I didn't pay a cent. However, some of the bills went to collections- the insurance company took a while to pay it, I guess. I never knew about this until I saw it on my credit report.

It shows on my report as a paid collection from a CA.

But I never paid it, the insurance company did. I tried disputing it several times, tried talking to the CA (big mistake), and nothing works. the CA says that it was my responsibility to make sure it was paid- that if the insurance company took too long to pay it, I should have paid it, and then had them reimburse me.

Whatever. They won't remove it, and Experian refuses to investigate further.

But is this something that really SHOULDN'T be on my report? I mean, IS it my fault?

How can that be my fault, when it was never my responsibility to pay it?!

So, a collection agency is reporting it? If so, you should be able to use the HIPAA letter successfully. These people are really incredible - you are stuck in a hospital, or incapacitated somewhere because of someone else's negligence, and they up and ruin YOUR credit instead of the responsible party.

But they're reporting medical information. That is the violation of HIPAA, as I understand the letter.
