Question: if someone has a unpaid collection from 5 years ago and pays it now....

Will they be able to remove it from their report as if it was paid from the dofd or does it reset? He is under the 5 year NYS rule.

Yes as soon as it is paid and there is proof of payment then it would come off .the catch to that is you have to go right to the CRA and demand it. ALSO it doesn't have to be paid in full it can be legally settled for less than full amount or paid settled in which both would warrant the deletion I mean why pay more than you have to right

With experian it has to be paid in full. According to what they say...

With experian it has to be paid in full. According to what they say...

Experian is full of Sugared Honey Iced Tea. Tell them to prove it, or get them for violating your rights.

Which "5 year NYS rule" are you talking about? Is it a collection or judgement?

They tried the same with me then I said lets see what the CFPB and FTC and the NY attorney General say about that next day it was gone gone. And no it wont reset once paid it goes off of dofd not Dola and to hhllc it is with both paid judgements and paid collections that fall under the 5 year CRTP statute.

Catch is as far as I understand you have to be a permanent resident for at least 6 months or a year to take advantage of the rule

You threatened them and experian removed it? Did u actually contact a attorney, the FTC and cfpb? Was yours settled or pif?

Just threatened number 1 and number 2 what do you mean by transferred? What does the tl say? Mine was settled legally for less than full amount and it was included a deletion of another collection agency for a different account for same thing even though it wasn't at the 5 year mark yet

If they still own the account then I would try and settle with them for I say maybe 10% then see if they bite I wouldn't go for more than half though

Nobody owns the account. It's on his cr, but it wasn't sold to anyone or at least doesn't show it

Well have him DV the thing then and if it comes back verified then send a settlement letter

Who is it through? And when is DOFD?

He can't dv it because he doesn't have anyone to send it too. The dofd Is early 2009

He can DV the company that is currently reporting and if they dont validate it gets deleted and if it does then you will have the answer to who owns it because they will tell him

Nobody is currently reporting. It shows as a transferred charge off. I think it stopped reporting a few years ago. But whoever bought it, isn't reporting anymore. What should he do?

Hmmmm ok so who is the OC? Origional creditor... sounds wierd that he would know that it was a transferred charge off but not know who it was by.

The oc was us bank. It says the account was transferred/sold. Their isn't anything on his report reflecting to where it was sold and transferred too.

Then he would have to contact us bank and figure it out unfortunately since us bank sold it as far as experian goes it will remain the full 7 as far as I know im having that issue with credit one bank

But it all came off of eq and tu on thier own

It's only 5 years in nys though. Why 7. Doesn't make sense

It is 5 years on a charged off PAID debt since they sold it unfortunately experian is a douche about it unless you paid the OC before it sold the debt then you have a case but if not then you can try to fight ex on it but I havent been successful as of yet

Easy to say when YOU don't have to deal with EXP.

Who is it through

DV is not for original creditors. It is for collection agencies. And, just because they don't validate it, doesn't mean it gets deleted. You will need to fight the CRA's with your claim

of nonvalidation to get it removed.
