Hello.. I'm ready to begin my credit repair journey (for the second time). I'm not new to the forum. Back in 2005 due to me finding this forum and reading the post of all you knowlegable people I was able to bring my credit score from the low 300's to 600's. I was truly grateful to you guys and also proud of myself. Due to me experiencing a bad pregnancy in 2007 and being placed on bed rest my credit started going downhill at that point. Seems like once you are behind it is a dominoe effect of everything else going wrong. In Feb 2011 I was laid off from my job. I decided I am ready to tackle my horrible credit again. I would appreciate any advise you guys can give me on which steps to take to try and begin cleaning up my credit. Thanks in advance. :D

After you have Re-read, THEN start asking us questions. Your issues can be solved with the strongest state consumer laws in the nation on your side.

 

Another Note: Centerpoint will pay for delete(I did that, bill was only $48). I have the contact if interested. I will direct Texas Man Cprems to this thread as well. We can point you in the right directions...

 

Also(and again, I know you aren't a newbie), becasue Texas laws are so specific and different than what others on CB are dealing with, put Texas in your thread title. It will help weed out well meaning, but not applicable, advice from CB members living outside Texas.

Racegirl1 welcome to CB.

 

Get paper copies of your credit reports. See if your OC's have a zero balance and say "sold/transferred"

 

Find out the dates of your SOL (Statute of Limitations) Texas is 4 year SOL for most consumer debt.

 

READ the Texas Finance Code Chapter 392 and Business and Commerce Code 17 - these will be referenced as the TFC392 & BCC17

 

First sort out who are OC's (Original creditors)

 

Sort out who are CA/JDB (Collection agencies/Junk Debt Buyers)

 

Also a list of WHO is collecting on behalf of the OC.

 

Your list should look something like this:

 

OC name SOL CA collecting CA bonded CRA reporting

xxxxxx date xxxxxxxxxxxxx Y/N TU/EX/EQ

 

 

Make a spreadsheet. Do NOT post on here who is collecting for whom. You can specific questions about the CA/JDB at a later date.

 

Find out IF these collectors are bonded as required under Texas law. - http://direct.sos.state.tx.us/debtcollectors/DCSearch.asp

 

Type in the collector name in the principle name column and place an "%" at the end. USE the search icon on the webpage. Do NOT hit enter on your key board.

 

Next route is a Texas DV to the CA's/JDB. Use ONLY the TFC392 in your disputes. NEVER use Federal law (FDCPA & FCRA) - you can use these later IF it comes to that.

 

This should get you started. Read any and ALL posts my Waltg55, Centex, Ashlia, Gjnnits (sp) and myself. There is a wealth of Texas related info on here.

 

You CAN do this. It WILL take time and persistence.

 

Update this thread once you get everything situated.

Good morning guys,

I completed all of the steps Cprems advised and I found two of the collection agencies on my report their information came up as not found when I searched the debt collector site. I am in the process of sending out all of my DV letters. My one question is the OC accounts that are showing sold/transferred do I send a DV letter to them also? All of my OC accounts dont have a collection agency on my credit report that is collecting on their behalf.

Post the CA names OR PM me if you do not feel comfortable posting that information. Lets make sure they are not bonded as required under the TFC392.

 

As for the OC's - Leave them be for the moment. You can tackle them at a later date.

 

Lets deal solely with the CA's for right now.
