Debt collector sending papers to my house & warrant?! WTF? Help?

Phone number for the guy/place is 800-214-5323. It was from Bank One originally for a car loan. I owe 3230 according to the guy I talked to. He was very mean and threatened police action and them deducting 25% of my paychecks to pay them back.

 

He told me He would send papers over implying they are for the start of legal action and that I will be responsible for court fees. They already repossessed my car and I have been without a vehicle for almost a year struggling to get back and forth to my job. 100% of my paycheck goes to back bills, food, and rent for me to survive!

 

This guy did not seem to care at all even though 2 years ago I had 2 lung collapses and went absolutely broke because of them.

 

Does anyone know if this guy is a lawyer or what debt collection agency he works for?

 

 

OH I forgot the most disturbing parts. Once he called my cell phone and left a voice mail demanding that I call him back within 15 minutes and "time is ticking" in a VERY disturbing voice. Almost made me think I had a stalker or an enemy who wished harm upon me. (I still have that voice mail). He also called my last place of employment and told them something about a warrant and that I need to call him and he knows I still work there. (Which I do not).

 

I'm broke. I can hardly pay for the things I have right now. Apparently he can't wait a year for the money even though the bank already has my vehicle and sold it at auction.

Keep( SAVE) any messages he sends....wish ya kept the 1st 1, it was ILLEGAL and could've gained ya the money ya need to help pick your financial self up

he also wont likely give you a mailing addy willingly but you can try

If so, DV his lying tail so fast his head will spin

 

if he doesnt give ya an addy, Id continue to seems truly scared & worried...but make sure you let him know you have no checking accounts or credit cards to pay him....ya need him to give ya a mailing address to mail a money order to ( do not agree to Western Union)

 

then ya need to search this board for a user named WHYCHAT, follow the link in his siggy ( the link is also pinned on this forum somewhere) and follow the directions there

Sounds like Giove or someone else from Buffalo. Don't worry, you're not going to jail. They can't take any of your money without a court order first.

Sorry to hear that, the basics are:

 

1. Stay off the phone

2. Keep a record of everything, phone calls, letters, etc.

3. Keep everything in writing to leave a paper trail

4. Send a limited C&D, DV the SOB

5. Read up on whychat

The very first thing you need to do is send a DV letter with a limited C&D (I dispute this debt, please provide validation, please do not call me).

 

Then you need to go buy a phone recorder. They aren't supposed to call when you have a limited C&D but they probably will. If they call record it and say, "I sent you a letter saying that I only wish written correspondance. Please do not call me," and hang up.

 

You also need to write down all the threats they've made and the timeframe. PUll your credit reports, too.

 

This guy is breaking the law. If you keep a good record you could recover more money from what they're doing than what you owe.

 

One last thing- check on WhyChat's site for the statute of limitations for your state.

JUNK DEBT BUYER....the lowest of the low of collection agencies...they will threaten, harrass, or anything else to get you to pay....follow the advice above and don't stress. They are scum.

I called that guy back and this time he gave me a different phone number direct to him 800-214-7853. I saw what you guys were posting and I asked his name is Jay Smith works for commercial recovery systems in Dallas Texas. NO mailing address because he wouldn't give it to me. He only wanted me to get money from friends or my g/f or something and western union it from my post office. Also he would ONLY fax me the paperwork. He refused to mail them to me? He told me legal would have it on next tuesday. I think he's blowing smoke, but I'm not sure. I can't afford 25% of my pay being taken out. Not even 10% of it!

Pull your credit report just in case they're reporting. The address may be on there.

You are entitled to 1 free credit report a year. Go to www.annualcreditreport.com. Or you could subscribe to a service like True Credit, which will cost monthly, but would be available immediately.

Get a copy of your credit reports. Annualcreditreport.com is a good place to go to get them free.

Go to www.annualcreditreport.com - it's free.

 

The way to know if what he's doing is legal or not is by reading the FDCPA - Fair Debt Collection Practices Act. It is a collection of laws that govern the collection industry.

 

We can also help. Most of us have been down that road.
