  9. Centex, Since they've already violated TFC 392.101. Am i entitled to a settlement through (TxDTPA) Sec 17.5052? Sec. 17.5052. OFFERS OF SETTLEMENT. (a) A person who receives notice under Section 17.505 may tender an offer of settlement at any time during the period beginning on the date the notice is received and ending on the 60th day after that date.
  10. Centex, thanks for the help so far. So essentially they can't respond because they will be in violation of TFC 392.101. The basically have to return the account back to the OC, but they've already damaged my scores. I checked yesterday and they dropped 40 points each. I'm afraid this will continue as the OC will try and sell the account to another JDB and thus further dropping my scores every time it shows as a new collection account.
  11. Centex, would asking them to validate the debt under TFC be a waste of time though? The debt is legit and not yet past the SOL, so i know they'll validate.

  13. Ok, so your'e saying i should still DV them and ask for a modification or deletion, but let them know that they're in violation of Section 392.101. Is this a violation of TxDTPA and can i invoke it? Thanks
  14. Centex, It seems that the only thing i can dispute, is the fact that they're not licensed and bonded to collect in TX. Is this true, or am i missing something? Can and should i DV them under TFC 392? Are they obligated to modify or delete the tradeline if they're not licensed and bonded to collect here? Thanks
