Jumpin in to say I picked up the 30-Day Shred and started it Tuesday. I had been doing P90X for a couple months but I wasn't really into the weight training stuff. So, I will be doing P90X's KenpoX and Plyometrics combined with the 30-Day Shred. Pitiful as it sounds, I need lighter weights for Level 1 of Jillian...started with 5's and my arms/chest are KILLING me. BUT, I do like that the workout is short and gets me movin'. Two thumbs up...so far. We'll see how Levels 2 and 3 go.

Were these verbal arrangements or did you sign documents? If you signed something, wouldn't/shouldn't you have received copies of what you signed?

TU score (I know not true FICO but I have free monitoring for a year) as of 11/27: 710 TU score today: 664 AMEX charge-off just hit Guess it could be worse. CA isn't reporting...yet. BK'ing soon so I'm nervous at just how low it will go. Other than the charge-off, I am keeping accounts current until filing. Hope that helps a little bit. Don't want any 'lates' adding to the slow and painful demise.

It is legit. I got a year free monitoring offer a few months ago. IIRC, a web-site I ordered from MAY have had a security breach of some sort. Not sure if it is the same case or not.......

Dear CA Lawyer, In regard to the complaint number listed above, I would like to propose a payment of xx amount to settle this debt in full and to avoid future litigation. If you agree to this offer, please send me written confirmation of your acceptance. Upon receipt of your letter, I will remit payment in full by cashier’s check/money order by xx/xx/xxxx. Also, I would need written confirmation that the forgiven portion of the debt will not be sold to any other collection agency or returned to the original creditor for future collection efforts nor will the forgiven portion be reported to the IRS. (I do not know if I would add your following statement or not. Guess it couldn’t hurt??) Also please consider, that I am an unemployed parent. My only income is from unemployment benefits and child support payments. Both of which are not subject to levy under New Jersey State Law. Please have your answer back to me in ten (10) days. If so, you may want to also negotiate how they report (PAY FOR DELETE). Worse they can say is no and, I guess if anything, it MAY show the court you were willing to work something out before hand (not at all certain if this would even be admissable in court or not so don't take that as fact). I also think that the full C&D prompted their actions. Nothing says you can't negotiate with HH&L. Did HSBC 'sell' the account to HH&L? (Sorry I didn't read all the way back from the beginning). If so, they probably paid pennies on the dollar for the debt. Have you contacted HH&L with a payment/settlement proposal? Also, ask yourself what is the worst thing that can happen if they sue you? Can they garnish your wages? Can they put a lien on your property? If yes, then I personally would be busting my butt to settle before the court date.

If the accounts have been charged-off, you generally have to deal with the CA's. Yes, it is accurate. Also, time is on your side. The 'older' the charged-off acccounts get, the more the CA's are willing to settle at lower percentages. As usual, YMMV (your mileage may vary from other's experiences). If the OC offered 5K, how much do you think they sold the debt to the CA for? More or less? <wink> Some CA's will do payments, some won't. Again, YMMV. This is why as part of your settlement letters (EVERYTHING IN WRITING), you stipulate that no part of the remaining balance will be sold to any other collection agency nor returned back to the original OC for further collection efforts. If they don't agree, you don't pay. 39K is a chunk of change to say the least. Have you checked into Chapter 13? Pretty sure it protects all your assets and puts you on a re-payment program (certain percentage of debt 'forgiven' and you pay back the rest). I have 14K recently charged off and am scared to death I will be sued/garnished. Meeting with BK lawyer in the next couple weeks to figure out my options if the CA won't settle with me. -
How so? FWIW: I do not go by my full legal name 'LittleB' so it is reasonable that someone who may have answered the phone did not recognize the name as being me. How can they prove it was ME that answered and told them there is no such person here(I guess on the other hand how can I prove it wasn't me )? They obviously don't believe me anyways because they continue to call even though I have asked them not to.

I have done this again today. I was able to track down a FAX number as well and I FAXED it and printed off the transmission confirmation. Sending original CMRR. I don't want to completely tell them to buzz off (full C&D) because the debt is well within SOL, very valid and the OC is AMEX. They've filed at least 5 suits this year in our small-ish city.

I do have the green cards and copies of the letters, can take pictures of my cell phone calls, can have my Mom document the phone call she got today, and I have the log of calls to my work in a WORD document. The thing is, I just want the phone calls to STOP. That is all I am asking! If they won't settle, I will be filing BK and they won't get a dime. I just want to settle this and be done with it. That is my goal.

I was under the impression that a CA has to stop contacting a debtor by phone if they are requested to do so? This is not AMEX (OC). NCI is a CA. Guess I need to go back to FDCPA 101.

Background: last payment to AMEX was 9/09. I was on a special payment plan. Last actual 'full' minimum payment was made at least a year ago. They are not reporting me late as of yet (TU. Not sure of the others). NCI now has the debt. Not on TU yet. Early October 09: calls started to come into my cell and work from NCI. Also calls to my husbands cell. Sometimes they left a message. Sometimes not. Always stated they were calling for 'location information on LittleB' I sent a CMRR asking them to contact me in writing only and I gave them my address. I stated in the letter that personal phone calls were strictly prohibited at my workplace by my employer. I did not DV them because, well, the debt is FRESH and AMEX has excellent records from what I have read. Other than DV'ing to stall, I didn't see the benefit. I GAVE THEM MY CORRECT ADDRESS=LOCATION INFORMATION. They sent me a letter verifiying that they now have the account, blah blah. I replied to the letter with a settlement offer. I just want to get out from under the debt (14K) ASAP. If they can't agree to settling, I will be filing BK and I told them that. Again in my letter I asked that they not contact me at all by phone. I also made reference to the first letter I sent making sure to let them know exactly when it was sent, delivered and signed for. Again, I gave them my address. They CONTINUE to call me at work, on my cell, my husbands cell and today they called my MOTHER. I was literally on the phone with NCI at work and my mom's call came in right in as I hung up from NCI (told them there is no one at my work with the name LittleB. He tried to get more information out of me but I hung up). I have not lived at home for over 20 years. I did not want my parents to know what was going on and, while he didn't say he was from a collection agency (he said he was with AMEX), they now know something is up. I told her to tell them to stop calling her if they call again. What do I do now???? I have the incoming missed call logs on my cell phone. My work doesn't have caller ID and when I *69 it says 'wer're sorry, the last number that called your line is not known'. I have kept a log of calls (in WORD) at work. I'm in Ohio. Should I answer their next call, tell them AGAIN not to call me, and record our conversation?
