I have an older credit card account with Barclay's that am hoping to settle on that was closed Dec. 2016 and my credit reports show as charged-off. They last reached out to me in March 2017 with a settlement offer but I wasn't financially able to agree at that time. Now I am in a better place with some money in hand and I would like to try to settle again if it's not too late...
Fast forward to last Sunday, I received a summons with 20 days to respond to the court/assigned local law firm. The plaintiff is showing as Barclay's Bank though, so I called Barclay's in an attempt to settle but I was told they no longer had the account and it is now with Trak America. So I called Trak America and they told me I needed to call the law firm listed on the summons because all they do is assign debt collections out, but they did tell me the firm did not buy the debt, it still is Barclay's.
My question is, if Barclay's is the plaintiff and the assigned law firm didn't buy the debt, why will Barclay's not talk to me to discuss a possible settlement (Or should I try again with another phone number maybe?). The summons also states that all responses need to be filed through the court and served upon the plaintiffs attorney, but I was hoping to avoid all of that. I just want to settle...and avoid a dang judgement...if it's at all possible at this point?
Does anyone have any advice to offer in how I should proceed? I have looked throughout the forums here and I am not finding anything related to my issue.
