If I sent a cease and desist all contact, then they can make contact via letter stating their intentions. This was a simple DV where I asked that they only contact me in writing. My fear is if I call them, that opens them back up to make contact by phone.

I sent out a DV to CBC last week via certified mail. They signed for it on Monday (6/1). I JUST got a voicemail from them this morning. My DV included a paragraph about contacting me in writing only: "I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls or correspondence sent to any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter." I've NEVER been contacted by them before, so I can only assume by the timing, that the DV is what triggered their call. What do I do now? Should I call them back and use their blatant FDCPA violation as leverage to get this off my report, wait out the 30 days and see if they can validate, or do something else?

I had six entries for medical collections show up on my CR about 3 weeks ago. Same CA (Senex Services), same OC, separate accounts for each charge (it's like they are trying to eff my credit up as much as possible). I disputed with the CRAs and they all came back verified. This is where I screwed up, I think - I sent a DV to the CA, but didn't use the medical DV (I stupidly didn't even think about coming here first before sending my DV off). Today I get 6 separate letters in the mail from the CA with a form letter where they checked off things like "explain the reason for your dispute". With each letter they attached something that looks like it came from the hospital that has the procedures done (very detailed like the exact blood test done or abdominal ultrasound or inpatient stay), amount that was charged, what insurance paid, and what the remaining balance was. Where should I go from here? Do I have any teeth to go after the OC for releasing this information to the CA? Or am I stuck going back to square one?

I signed up for the Equifax credit monitoring service on 1/1, and disputed the 5 credit card accounts I had that were IIB which included two CapOne’s (I think one was the Orchard Card). Same night I applied for the CapOne card others have had luck getting approved for post BK (first app since filing BK 18 months ago), but got a generic “You’ll receive a response in 5-7 days”. Next morning had an alert that CapOne had pulled my Equifax report for the app. Wednesday the 9th I got two Equifax alerts for CapOne. One was an account change where they updated my CapOne TL to show I was disputing it. The other was an TU inquiry from CapOne. So my question, is Equifax just slow at showing inquiries for Exp and TU (8 days after I applied for CapOne), or did CapOne pulled my TU after I disputed the IIB cards I had with them?

Or is it just me? I have the Equifax Complete Premier Plan, and whenever I try to log in I get "We apologize for the inconvenience, however due to a system delay please check back again in 24 hours" for each section. I got two account alerts in my email, so I'm curious if it's two of the accounts I disputed last week.

I would send the DV if it were me. With as many foreclosures places are dealing with, and so many who don't have the proper documentation, there's a good chance this one won't have it either. If they have the documentation and they know it, there's probably a good chance they'll sue anyway. But if they think you know your stuff, and they don't have the proper validation info, it's easier to make them go away. Plus you want to make sure they have your correct address in case they do sue. The reason I say that is they could use another address they find for you to sue, and if the letters aren't returned to the court, they could get a default judgement and you wouldn't know until it started coming out of your check or bank account. If they do sue, you can either take the chance and go to court, or go ahead and file BK. If you file BK before a judgement, you won't end up with a judgement on your account. There will only be something in the court records that they filed.

I just started on my journey to re-repair my credit 1/1. They were on my report I pulled on the 1st, and then yesterday I got an alert from equifax that I had a new collection from Tek-Collect. The old entry isn't showing now, and the new entry is the exact same except for the "date reported" which went from 12/2012 to 1/2013. Is this something the CA did, or is this the way equifax handles collections when the CA reports info each month? Also, does anyone know what they are (JDB?) and who they collect for? I tried googling them, but it didn't tell me much. The only outstanding collections I have would possibly be for medical, but this is listed as retail. I can't think of anything it could be since I don't write checks, and all the other debt I had was included in my bankruptcy in 2011.

^^This^^ Plus there have been a lot of class actions the past few years because of overdraft fees. You may want to google and see if they were one of them.

This was my thought as well. I had to get an attorney for the last place I rented. It cost me $400 to have him draft a letter and call the landlord. Small claims court might be an option for you as well since the amount is lower (small claims here is anything under $3,000)

Bankruptcy isn't going to help your score. If you have a lot of recent negatives and people coming after you, it will stop that, but your score probably won't change at all. People think a BK wipes their CR clean, but it really doesn't change anything other than the accounts reporting as IIB. All your history is still there and still factoring in to your score.

I thought I'd ask before I call them in case others have experience or tips on what to say. I have a Citi card through work for purchases (but can't be used for travel). They don't report on my credit, but it would be so awesome if it did since it's paid off each month automatically by my company. Has anyone had one of these that they were able to get reported on their CR?

I'm trying to talk my mom in to adding me as an authorized user on her accounts (citi and Amex), but she's hesitant because she's afraid it will affect her. I sent her one thing I found online showing how I'm the only one at risk if she starts not paying, but she wants to call the bank. Is there anything out there I could send her to help reassure her she's safe? Also is there anything the bank might say to talk her out of doing it?

Oh, I totally agree with you. I KNOW he's depressed, and I've been begging him to go for counseling for months now. He has so many issues from his childhood that he's never dealt with. My insurance requires you to go through a certain place first, and they decide if they can handle it, or they refer you out. We've done that step (I even went with him to support him), and they referred him to a psychologist, but I can't get him to follow through. On top of that, he has a history of seizures from brain surgery, and I'm almost positive he's having petit mal seizures (mini) making him so forgetful and absent minded. But he refuses to go to the doctor and refuses to take the medication he's supposed to take. At this point, I feel I've done everything I can possibly do for him and our marriage, and my only options are to stay on the ship he's sinking himself, or build my own raft. That's how I made the decision to make sure I could provide for myself and my children, and be able to go out and get an apartment if I needed to. I could easily walk away and leave him stuck with this house, but I don't want to do that, so I'm trying to find the option that works best for us, while at the same time making sure I protect myself.
