  2. UPDATE - complaint filed with CFPB. Actually, it was a pretty empowering experience. I assume that at this point I do not contact anyone until I hear back? Thanks again for the help. This would be impossible to navigate without help.
  3. UPDATE - I have the letter together of file with the CFPB Today, we received a letter from our health insurance company that part of the medical service has been re-coded and is no longer owed. This is part of the debt CA is claiming to collect. Is there any way to use this letter to help me?

  5. Hello, I have a long-time debt with BOA on a credit card. BOA closed the account on 02/2012, but I have been making regular, on-time payments on the bill since then. I now have the money to pay the balance in full, but I am wondering if I should keep a small amount so that the account doesn't stop reporting the payments, utilization, etc? Does a closed account with a balance benefit me if it is in good standing? Thanks so much.
  6. thanks for this. I've checked on them, and they have been a CA with this OC for a long time. Couple of complaints filed. I have contacted a couple of consumer attorneys, but no contact back yet. In the meantime, the OC has accepted two payments of $25, and they have not acknowledged a new balance, or sent a statement. The response to my DV even showed two payments, but no updated balance. Needless to say, I'm not going to make any more payments until this is resolved, but I am thinking I send a letter to the OC demanding an updated balance? Their office continues to say they cannot discuss the account because it is in collections, but they keep accepting payment?? Any thoughts would be appreciated. We now have the money to pay the balance in full, but can't until we can prove the CA will go away... STILL not reporting on any CRA.
  7. UPDATE - CA response to DV letter Received a response to my DV letter. I have redacted it and will attach a copy if someone will please post how to upload a file here. Summary - 'Thank you for your letter. Attached is verification of the debt. Pursuant to 15 USC 1692g, we have responded. This debt has now been validated, and we will continue with legal action' The letter was addressed to me, but the salutation was to a totally different persons name (obviously a cut and paste). The letter also referenced a case in our county's small claims court vs me. The letter was signed by an individual with the 'Consumer Help Desk'. There were two attachments A 'Patient Fact sheet' branded with the OC logo, dated 10/10/2013 that had all personal information, including dates of treatment, etc. A number of things on this sheet were wrong, including the fact I am listed as employed, and I am not. A screenshot of some sort of medical billing software that shows dates of treatment, the dollar amounts, and how things were coded. This also includes personal information, including DOB, SSN, etc. Handwritten at the bottom was a total amount due (it seemed correct). There was no mention of the things I requested in the letters (per Why Chat's template), including anything I have signed with OC or CA. I am certain I need to reply to their 'Verification', but would appreciate any guidance on what the next letter should say!! SIDE NOTE - the OC has accepted one payment of $25 which they claim to have forwarded to the CA. No one has sent me a statement, or an accounting for this $25 in over 30 days. Any action needed here?   8. Again, thank you! I have the EOB from the insurance company, and I've verified the amount is correct. I am writing the DV and sending CMRR today. I'll let you know what comes of it!
  9. Thank you again for your replies! I already have opted out in writing, and deleted old addresses. I have the credit reports from all 3 CRAs and obtained them from 'annualcreditreport.com'. The OC and CA do not appear anywhere on them. I did have insurance at the time of service. I will review the EOMB patient responsibility section, and get back to you. I am certain the debt is owed by me, and I want to pay it in full, preferably without the CA getting anything. It sounds like, from what you are saying, I need to first send the DV to the CA. I am positive that this CA has a relationship with the OC, because the OC referenced them specifically, and continues to refer us to them. The link you posted does not appear to have a letter for that matches my situation. I assume I should still use the first letter not he referenced link. Do you still recommend the letters be handwritten? Thank you for your help! I will update as soon as I get the EOMB data or any other updates.
  10. What was the date of medical service?? How did you pay the OC-- with the HIPAA letter insert "a"?? Did you pay the bill in full?? If you paid the OC a partial payment without using the HIPAA letter program on an account that was turned over to a CA over 6 Months ago and is on your reports, then the OC had every right to transmit it to the CA. If you owe a very large amount and paid only a portion of the bill, and have already been threatened with a lawsuit, I suggest you get yourself a lawyer. Thanks so much for the replies!! Why Chat, The date of service was 07/2013. We have not responded to the OC or the CA at all, mostly due to a ton of medical bills coming in, was waiting to get a total before starting to make payments. I paid the OC with a check, and attached the original statement. I have not taken any steps on the HIPAA program, and wasn't aware of it when I sent this check (new to CB). The total bill is around $500. I paid $25 and was planning to request a payment plan. I have funds to pay in full, but I am not sure whom to pay, and how best to make sure the bill goes away entirely. The CA is sending statements showing fees and interest, and they have also sent paperwork claiming they are seeking a judgment in small claims court. Nothing on all three CRA from OC or CA at this point. Thank you for the info on 'forwarding' payment. What law governs this? Original contract with OC? Should I write a letter demanding an accounting from CA? I am ready to write letters or make payments, just don't know how to best make sure this goes away once I pay... Appreciate any help!
  11. Hello. I have opted out, and deleted old addresses. I have not sent any DV or disputes to anyone yet. I have a medical bill that was sent to collections about six months ago. I have not interacted with the CA at all. It has not appeared at any CRA. On 03/01/14, I sent a payment to the OC, and it was cashed. I requested they send me an updated balance, and they said they could not discuss anything because the account was in collections. On 04/03, I received a paper printout from the OC that showed my payment as accepted, but did not apply it to an account. there is a handwritten note at the bottom that states the payment will be 'direct paid' to the CA. Can they do this? I am ready to write letters, but not sure exactly whom to write to? I have the money to pay the rest of the bill in full (about $500), but I am worried I will not be able to prove payment without a statement from the OC? Also, we just this week received paperwork that the CA is filing a claim in small claims court. We did not respond. I know that an account cannot accept payment, pursue collections and small claims all at the same time, but I am unsure of who to respond to, and what type of letter to send. Any thoughts would be greatly appreciated!

I closed on a short sale of an Oregon property in JUN of 2011 I had a first, and second mortgage with Chase bank, and both were included in, and agreed upon, in the short sale paperwork The first mortgage is reporting as 'Charged Off, Written Off $XXX Past Due' How do I go about correcting this error to 'Paid in full for less than full balance' ? The second mortgage is reporting as 'Paid in full for less than full balance' ! Thanks so much CB, you guys are awesome!
  15. tkoband, What do you mean by 'grievance'? I'm not familiar with the term... I have a similar problem. I have completed short sale that is reported as 'CHARGE OFF - FAILURE TO PAY'. and it was actually settled in the short sale. If you have more detail on how you filed this, please post, or message me.
