My husband has been cleaning up our credit reports andhas a plan of attack for most everything. When I looked at his notes I noticedthat there are a few that don't have anything written next to them. These 3 areon my credit reports.

2 Student Loans (US DEPT of EDU) one has a balance of $74, the other $42. Theyare defaulted, loans originated in 1997, last payment (tax return offset) wasMarch 2009 for $5500+. The reports say that they are scheduled to stay untilMarch 2013. I'm confused as I thought it was 7 years after the last payment.I'm not sure if we should just pay the remaining $116 or not. I personally amafraid to dispute it, since I know it is mine and I was simply irresponsible. Iwas hoping that if we paid it they'd just remove it upon request. My experienceduring the offset was surprisingly helpful, the lady I spoke with tried to getit so I could rehab the balance but it was too low for the program. Not surewhat to do with it now.

The 3rd is Midland Funding for $3700+ is waypast SOL but reports as an open installment account. Says it was opened 11/2011 and scheduled tostay on report through January 2014. This account is somewhat valid, the amount is correct from Tmobile, butI closed the account when the charges came up. They removed them initially and then replaced them stating that I wasliable for the calls to another country. I tried several times to clear it up then decided just to let itgo. Was never on collections until2011. I closed the account with TMobile,I believe 8/2006, last payment to them was 7/2006. So with the 7 year law shouldn’t that FOAD by7/2013? I’m really hoping I can justdispute and it’ll go away, but I’ve been reading on here and see that severalpeople have problems with Midland (this is the San Diego branch). Again, not sure how to proceed with this.

Seems like I read here somewhere (since I have no personal knowledge) that federal debts never get off unless paid? But I could be totally wrong. As for Midland, you could try first to write the CRA's and ask for them to delete it based off obsolescence. If that doesn't work, DV Midland for VALIDATION, not just verification. Midland is tough to work with, but many have overcome them :) Just do a simple search too and you'll find loads of into here on them.

I am pretty sure you are right about federal debt not going away, so I was surprised to see it listed as coming off in 2013. I'm thinking we'll just pay it now and then ask if they'll remove since it originated in 1997. It says that it originated in 2005 though, but I have my original loan documents that show 9/1/1997.

I will read up some more about success with Midland...this is by far my worst account so if we get rid of this I'll feel so much better :)

What month in 2013? Maybe you could also use the same reason for the CRA's.

Says it will be reported til May 2013. I was thinking I'll call tomorrow and pay both off and then ask if they can update with the CRA's as it really is so old. If they say no I'll wait a month or so and dispute with the CRA's. I think I have the phone number for the lady I spoke with in 09 and I think that if she is able to she'd get it off...but I don't know if she has that power or not.

Thus far on the Midland all I find is people who are currently fighting them and then the class action information, I don't know where to begin with them. I'm thinking I'll send the DV and keep my fingers crossed, I'd even do a PFD but not $3700+. If they verify/validate I think I'll send a pfd letter for $37.00 :)
