Denial due to Chexsystems, file empty.....

DH filed BK in 2007 and it was discharged in November of that year. One of the items in his BK had been a joint PNC account with his ex which had numerous overdrafts. He tried to contact Chexsystems numerous time by calling the number he was given by my CU, but each time he had to leave a message and was told his call would be returned within 48 hours...needless to say, he NEVER received a return call.
Fast forward to July of 2012; while looking up the telephone number for checksystems so that DH could try again to find out why he showing up on their system, I came across the place to order a copy of your checksystems report, so I ordered and sure enough, when it arrived it did show both bank inquiries, but the files were all blank...WTH!!! How then could we have been unable to add him to my account based on information reported on checksystems when his file is blank??
Thinking that maybe I was misreading all this information, I went to my CU today to discuss, showed them my report and they verified that what I was looking at was indeed different than what they were issued. The banker ran him again to see if he was still appearing on their report and as of now he is not. I asked my banker for a copy of the report that the CU received from chexsystems and I was told I could not. Because I pressed the issue, the VP of the CU came out to talk with me and said they could not give me a copy of their report because it would violate the agreement they have with checksystems. WTH!!!!! How is that even legal??

Similar to a recent post, in 2/11 I was trying to add my then fiance to my CU banking account but he was denied due to info. that appeared on Chexsystems. All the banker would tell us is that it had to due with an overdraft account at PNC from several years prior and we needed to contact Chexsystems for more specific information. In 6/11 we tried again to add him to my account with the same end result.

What was the date of the PNC overdraft? Chex has a 5 year reporting period. Could be that the 5 years has passed since 6/11, and the report is now clean.
BK that includes an account showing on Chex, doesn't delete the account for reporting purposes. At least that's the way it is for other accounts, that are reported to the 3 major credit reporting agencies. I doubt that Chex is any different.

PNC also reports to EWS and many credit unions now use EWS. Sometimes people in the branches are not aware of EWS being used and will simply get a denial code and they believe it is from chexsystems. It might be a good idea to get your EWS report too
