My DH has a defaulted SL original creditor was AES and backed by Wachovia. It was a program called Educaid at the time (don't know if that exists anymore). We thought that they were all PIF, but apparently there is one that slipped through the cracks for $1400.

 

We both consolidated years ago after grad. This loan was not able to be consolidated because it is private. We have a CR from the end of May. The TL on his credit report says nothing about govt backed. It only states that it is charged off with Wachovia.

 

Suddenly calls have started from Williams & Fudge. We have received nothing via mail. Last night his mom got a call and they were asking where he lives.

 

I don't understand why they wouldn't have that information since it is all correct with the OC and on his CR.

 

What we would like to do is verify the debt amount, whether it is indeed private or govt backed and make the phone calls to family stop. They have a phone number for him (he doesn't answer their calls) and one for me (I don't answer them either). Honestly without serious research we would have no clue who it is or what it is for since they have never identified themselves even on his VM.

 

Does he need to answer one of their calls or (God forbid) call them back? We can obtain W&F address to send a letter, but do not want to do that without some info from them to begin with. I'm not sure how to advise him on this one since it is SL and they are being very deceptive and sneaky for no good reason.

I do not recommend DVing any student loan. Make some calls and verify it yourself. DVing to student loan collectors/holders is a stall tactic and signs of a difficult borrower. Considering the fact that private loans do readily sue, you want to stay cooperative.

 

They are calling your references because you are not answering the phone. You need to deal with it, on the phone. They will not negotiate in writing.

 

Dont know why you would call them deceptive or sneaky...they simply doing their job. If you dont answer your phone, they will start calling references. Pretty standard procedure.

I guess the reason I feel it is deceptive is that they have never identified themselves or why they are calling him. The only way we have any clue who they are is from doing reverse phone number lookup. The reason it really threw us for a loop is that this CA is ironically located in SC in the town we live in so it took some research to even understand that it was connected to a loan through a school in FL.

This doesn't sound like a private loan. Did it show up in the NSLDS?

 

No. Never.

 

Why doesn't it sound like a private loan to you?

 

I just don't want the SOL to reset if we do something, even if it is just factfinding with this CA. SOL for our state is 3 years and wages cannot be garnished at all. It's been two years since there was any activity on the account.

Collection agencies are not permitted to identify the reason and or nature of the business they have with an individual. That is why they do not identify themselves. This is federal law and is covered under the FDCPA. Williams and Fudge represents at least 900 colleges and universities nationwide.
