Hi Everyone, This is my first post. The main issue I have is a broken apartment lease that is with National Credit systems. Any advice on attacking this? Thanks!

I'm going through the same thing. After this month it will be my only baddie left. How long ago did you break the lease? How much are they saying you owe? And, is it reporting to all 3 bureaus?

Hi! Thanks for the welcome. They say I owe over $5,000 for a lease that I broke about 3 years ago. I previously paid for a credit repair service, and they were able to get it deleted from EQ, but it is still on TU and EX.

 

I sent a valisation letter "nutcase" I guess it was it is called to National credit systems/CA. That was on Jan. 27th. Got the return receipt, but no response yet. What have you tried so far?

Well, mine's half of that and I'm taking it slow with them as I don't want to wind up served and in court with them. You'd have to look up your state's SOL and take it from there.

 

I'm not too well versed in leases and ways around them once on reports. I've successfully made all my other baddies go away, and if I have to, I'll save enough up to settle as long as I can get deletes.

We have something in common...National Credit Systems!

 

I DVd them and today I received a letter from them with a copy of my signed lease (first and last page). The letter basically said if I have any information contrary the info they have, to send it to them and will either delete or alter the listing. Unfortunately, I don't have any of that special info :lol:

 

I did look them up on OCC and didn't see them to be licensed in Texas, but I asked if Centex could offer up any info. I have somethings up my sleeve that I'm going to try :ph34r: I'll keep ya'll posted.

I had a broken apartment lease in TX from way back in college. I moved out and my salamander roommates decided to abandon the place. Anyway, the SOL on that is 4 years. If they're not bonded in TX, the CA could find themselves in deep doo doo.

I just thought about something...on televised court shows, when someone brings an old roommate, who abandoned the other roommate, to court for back-rent, the judge asks what the party did to mitigate their loses, ie, get a roommate as soon as possible. Now, these apartment companies are charging for breaking the lease and charging quite a bit. Shouldn't lease breakers only be responsible for the months that it took to re-rent the apartment, not the exorbitant amount???

I thought that was already the case

Not quite. Don't forget carpet cleaning, painting, repairs, etc. That's what they claim drove mine up over 2k.

Most state laws require landlords to make reasonable attempts to re-rent (so the landlord can't just sit on their flowers and ride out 9 months of a 12 month lease) and also prohibit 'double dipping' meaning the landlord can't continue collecting rent from the previous tenant once the apartment is re-rented.

 

Most courts will also recognize a tenant's "best effort" to help the landlord re-rent the place. If you can show you ran ads, provided the landlord with a list of potential renters and/or left the place rentable (clean carpets, appliances, no damage, etc) it would be pretty tough for them to stick you with anything more than 30 days additional rent.
