Loan Modification and in Bankruptcy Chpt13

Me and hubby brought home around 5yrs ago. The home is only in my name and i am the only one on title. Well I filed for bk back in July but because my husband is in Bk 13 and will be finished in Jan 10 we have not been able to make house payments. They are taking 1200.00/month from us and he is not making the overtime he used to but still is getting 40 hrs a week. Well we are behind in our house payments from sept until now and they have already sent foreclosure papers. (about 2 weeks ago) My husband wants to keep the house but when talking with our attorney, he stated that we could get a deal by continuing to pay the house payment, and then additional payments every month that could total up to 1k for the next 6mos starting in January. i just don't see any way we will be able to do that especially with husband going out for surgery on the 17th of Dec. He just have surgery on Nov 6 and I have surgery back in July and that is why our house payment got behind because we needed both incomes. I have talked to two mtg companies about refinancing but they said there is no way we can do that. If some one has some advice, it will surely be appreciated.

Did you talk to them about refiancing or modification? I know a lot of times while your in bankruptcy we won't modify your loan. I would try a repayment plan with your lender -- and that's not a not a option with the amount you want to pay --- last least choices: 401k, Short Sale, Foreclosure.
