I have a medical bill that I paid in full, used the HIPAA letter as written by WhyChat. It totally worked and I got the hospital to write me a letter agreeing to delete from all credit reports. This was back in July. The CA is still reporting on my Experian credit report. I've written to the hospital again, requesting for a delete, as promised in their letter. They have not responded to my letter and the account continues to report.

 

Should I write to the CA for a delete? Report the CA to the BBB? Include copies of the letters and send to the CRA? What should I do? Who do I complain to?

 

Thanks for any advice. This board is great.

It is not clear...

 

When you wrote the hospital the 2nd time (after agreement to comply), did you notify them that their collector was stll reporting? It is possible that they are not even aware if you have not specifically pointed it out to them.

 

They may very well have made sure that they didn't have a cra listing, but that does not mean that they contacted the CA to remove it.

 

Notify them that the CA continues to report on a bill paid directly to them, and they need to ensure that their collector complies and deletes record, as they are in violation.

I would write to the hospital and copy the CA...

 

something like:

 

"Dear morons,

 

I have recently checked my credit reports, and I am dismayed to discover that your agent is still reporting the information which you agreed to have them delete. This is totally unacceptable. This item MUST be deleted within 10 days. On day 11, I will be filing suit against both you and your agent in my local court. You are in breech of the contract you signed agreeing to have this item deleted, and your agent is also liable for that breech. In addition, your agent is in violation of the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. As the principal, you are liable for the actions of your agent, and therefore are also liable under the aforementioned Acts.

 

I will check my credit reports again on February 1, 2008. Should this item still be there, on February 2, 2008, I will be filing suit."
