if the OC is no longer on youre reports, and the JDB still is,

 

they have violated the FDCPA and the FCRA.

This account is past the Statute of limitations for my state and for Credit reporting as the Date of First deliquency on the Original account was on or about xx-xx-xxxx

 

 

AS you've probably read the latest FTC consent order and complaint with Asset Acceptance ( Jan, 2012) , it is considered a deceptive act or practice in violation of Section 5(a) of the FTC Act, 15 U.S.C. § 45(a)

 

1) To demand that consumers pay, in full or in part, debts that are beyond the statute of limitations. By demanding that consumers pay these debts, you have represented, expressly or by implication, that consumers owe these debts in the amounts demanded.

 

2) and you have failed to disclose, or failed to disclose adequately, that, in many instances, (a) ( JDB or Creditors name ) cannot require through a lawsuit that consumers pay debts beyond the statute of limitations, and ( b if consumers make partial payments on these debts, the statute of limitations period will be renewed

 

 

Pursuant to Daley v A&S Collection Assoication CV-09-946-ST, it is a violation of the FDCPA and FCRA to report an account that is past the Statute of limitations for reporting purposes

 

 

If I am contacted again by your firm or any Collection Agency that you have oursourced collections to, , I Will turn this matter over to an attorney.

 

If this account is not deleted from my reports from all credit reporting agencies, I will turn this matter over to an attorney

 

Please cease all communications regarding this account, Including indirect communications thru third parties collection agencies

 

Violation of the FCRA and your Illegal attempts to circumvent the FDCPA may result in a lawsuit.
