There was some confusion regarding licensing requirements for CAs in the State of Delaware. Delaware Code Title 30, Chapt 23 states that CAs must obtain a mercantile license in order to conduct business in the state. However, this is only a tax license and not a regulatory license.

 

Therefore, CAs located outside of Delaware, with no offices or employees located within the state, are NOT required to be licensed in order to collect.

 

Also, Delaware has no separate state statutes governing collection agency practices. They go strictly by the FDCPA.

 

I know there are a number of Delawarians on this board, so I hope this information is useful.
