  1. What if debt was accrued by a spouse in a non-community property state my the spouses stops paying on his/her debt because he or she will be filing BK shortly. Can the creditors come after the other spouse for payment? I also believe that the non-filing spouse who the debt doesn't belong to had filed for Bankruptcy chapter 7 a few years ago. Would that spouse be responsible for any of the other spouses debt?
  2. Hello there. What if a wife acquires debt in a non-community state and then the couple moves to a community property state such as Texas? Will the debt now become community debt even though it was acquired in a non-community state while they were married?
  3. I have a recent BK and a recent Foreclosure. (within the past 12 months or so for both) If I put down a decent %% down, are there Hard Money Lenders out there to give me a mortgage? I'm looking at putting down 25-30% down. The house would be in Texas. Also, what are the interest rates like with Hard Money lending? Can you also give me some info on what exactly hard money lending is? I think it is something like an investor being the bank or mortgage complany. Any helps would be awesome. Thanks!

  5. Foreclosure of the first? not exactly sure but my BK discharge happened in 10/2008...I think the foreclosure happened shortly after that. What if I do a died in lieu of foreclosure on the second property? How will that affect me getting a mortgage? Will a deed in lieu of foreclosure still warrant a 3 year wait?
  6. Hello, I filed for BK in 09/2007 and my BK was discharged in 10/2008. I let a house go in my bankruptcy therefore it was foreclosed on. How long do I need to wait to obtain a new mortgage? How much $$ down are lenders going to require me to put down? Also, I actually had 2 houses in my bankruptcy but only 1 was foreclosed on. I continued to pay on the other and I am still living in that house. If I walk away from this house (I never signed a re-affirmation agreement) would this start the clock all over again if they foreclose on this house as well? I know my BK 7 relieved me of the responsibilities of paying on this house even though I have been paying on it and living in it. I look forward to your insight. Thank you.
  7. Hello all, I am almost done filling out and gathering up all of my information for my loan mod request with Aurora. The last thing I need to do is a Hardship Affidavit. What do I need to do for this? I guess write a short letter explaining the reason for my hardship and request for the loan mod? Does anyone have any suggestions on doing this? Keep it short and sweet? Any key words or phrases I should put? Thank you.
  8. Will they frown if we contribute a large percentage of our pay check? Also, if our NET pay after all deductions cause our house payment percentage to be REAL high, can this be cause for them to refuse our modification? I heard they want to see a % higher then 31% but I wonder if there is a breaking point for being TOO high?
  9. Hello all, When we fill out the Aurora Loan Modification form, under deductions for our income, do we include our 401K contributions and our 401K loan repayments? These are technically deductions from our pay check but I'm not sure if we should include this. We contribute a decent percentage our our paychecks each week. We wil await your replies. Thanks all!
  10. Hello all. You people are such a blessing. Here is my situation, I filed for bankruptcy seven and my bankruptcy was discharged already. I let one house go in my bankruptcy but I am still paying on and living in my other house. My spouse did not file for bankruptcy and she is on the mortgage and the deed of the house we are currently living in and currently paying on. I think technically my debt on the mortgage that we are living in and paying on was discharged in my bankruptcy seven filing as I did not sign any re-affirmation agreement nor was asked to sign one. My mortgage company is Aurora and I have 2 loans with them. It's a 80 / 20 My blended rate is over 8 percent and I really need to get my rate down to 6'ish I requested and received from them a loan mod package for both loans. Is there any advice you can give me when me and my spouse fill out this paperwork? Thank you all and Merry Christmas.

  13. In the BK forum there's a thread called BK-friendly creditors... http://creditboards.com/forums/index.php?s...699&st=2300 it will be a big help and keep you from wasting time & inquiries. Just bear in mind, that the credit climate has changed a LOT in the past few months.. so I'd look at only some of the more recent postings, take the ones from a year ago with a grain of salt.. With that said, I'd say you have the best chance with Capital One or HSBC/Orchard... hope that helps. What is CJ ?
  14. Do any of the above mentioned BK friendly creditors blacklist against you if you filed Bankruptcy against them? One of my creditors in my Bankruptcy was Cap One. Thank you all.
