  1. Okay, now I just getting more confused. I have to tell the court why I am doing what I am doing in that 30 days? Can I tell them I am requesting validation from the CA and I don't know if I am going to agree to pay them or not until I hear back form them? Will someone at the cour likely tell me what I need to do? Do I have to commit to some kind of defense (not mine/outside of SOL/etc)? Thank you very much for helping me here - it is a lot to take in all at once.

  3. Thanks, I am going there now - so THEY have to prove date of last activity, which is when the SOL clock begins, right? For example, the latest receipt or payment or whatever they have showing I had something to do with it is when the SOL timeline begins, is that correct? So the people suing me have to : Prove it is ME who owes them (and I get them to do that with a validation letter) Prove the Date of last Activity (I ask them to show me this in the validation letter?) Then if they can do those two things, and we are within SOL, I should make nice and ask for a settlement, does that sound about right? If they cannot provide validation or their DOLA is past the SOL, I can just tell them to get bent, right? If it is truly mine, then the last payment or purchase would be pretty close to three years, but I couldn't say for sure. I am just assuming it is within the SOL or they wouldn't try to sue me, right?
  4. I think I am really being sued - it is filed with my county court. I was served with the papers at my house. What other info can I give that would help?
  5. I have looked at the sample validation letters, now I have a couple more questions. Should it differ in any major way since they are already suing? Also, should I send it to the attorney representing the collection agency, to the collection agency itself, or both? Any other advice? Thanks.
  6. I have gone for two or three years without getting any kind of collection letter or anything. Then as soon as I start trying to fix up my credit, the floodgates open and the wolves come out! Now I just got a letter saying I am being sued! It is for a company called Colonial Credit Corporation - I have never heard of them or had any dealings with them, so I assume it is a collection agency. The letter says I have 30 days to dispute and the attourneys will get validation and info form original craditor. It also says they are authorized to do this in my state. I don't know what the original creditor is, but it could be mine; I just don't know. I haven't had anything on credit in two or three years - I am guessing if this is mine, it is getting close to three years. Anyway, what should I do? *Should I get a lawyer? I really can't afford that. *Should I send them a dispute letter asking for proof that it's my debt? Ask for proof os SOL? *I am assuming if they are going to the trouble of suing me, they have everything they need to prove to a judge I owe them what they say. Am I wrong? *Should I try to settle and would they likely agree to do that rather than go to court? The amount is around $1500.00 and my state is Oklahoma. If there is any more info I can provide, just let me know. Thanks a lot for any help.
  7. Hello, I am not looking to get rich just yet, but I would like to get rid of some stuff I no longer use, and bring in some extra money, so it would seem ebay would be the way to go. I have read some of the threads on here and they have been really helpful, but I was wondering if anyone could help me with some info or tips on my trial run. I figure I will start with some old books, cd's, or baseball cards. I am thinking I will not do cards though, because they sell for so cheap. Books and cd's I won't miss, either. So I just set up a seller's account, take some pictures of what I am selling, then what? Do I use a credit card or paypal to pay ebay their fees? Their website didn't really give a detailed description. Thanks for any guidance.

  9. You can join a site like mycreditkeeper.com or privacyguard.com - the first has a $9.95 monthly fee, and the second is an annual fee, I believe. They both give free trials for one and three months, respectively.

  11. I have looked at the Credit Approved thread, but I wanted to get a little more suggestions if there were any cards to try for in the 500's. I understand there is a big difference between 500 and 599, but in a very general sense, what CC companies does someone with a 5XX FICO even have an outside chance at? From reading these boards, it look like: Target Guest Chevron Orchard Cap One What else? I want to wait until I break 600 with secured cards to apply for anything, but I am just thinking and planning ahead for the time being...
  12. Just to play devil's advocate, and since I am in the same boat, I was wondering about a couple of things. Not doing anything is only going to get it sent to a CA, then you will have the chargeoff PLUS another CA on there. Cap One seems so difficult to deal with, it seems best to just pay them off, and later on down the road try to deal with a paid chargeoff, rather than risk it growing into more money, have new CA's added, etc., etc.. Am I missing something here?
