  1. Thanks WhyChat. The account is surely less than a year old, but i am going to research and make certain. I will report back the outcome. at least this is a medical acct. i dont believe they have much weight anyway. I had two on cr and wells fargo didnt even metion them when i was getting the mortgage. now they are gone!
  2. just need a refresher. ive tried searching but i keep coming up with posts about CA reporting. In my case I just overlooked a silly bill of my wife's for $31. They sent me an initial notice and want payment. fine, i can pay it. but i dont want it on her credit. I forget how this works. If i just pay it quickly, will it be a non issue and never report? or is it already too late even if i pay it? if i pay it and its just gonna report anyway, then i need to make sure i take the right steps now. so, this is what i was thinking of doing. 1. Pay the debt. 2. simultaneosly send dispute of validity. is that right? or should i contact OC and try to pay then DV? i forget... they sent letter FEB 6. btw, it took years, but i finally fixed my credit up enough to buy my family a 5 acre estate in a VERY nice area! I worked SOOOO hard. and pulled so many tricks. it was down to the wire. I had to pull tricks at the closing table! temporarily got a vzw off just long enough to close. but then it went away permanently! but let me say, it is a struggle keeping up with it all. now i just want to pay everything off and never use credit again. im always worried im gonna miss something or forget a payment like the one above. i blame that one on the wife though:)

Thanks. i did request validation. im just worried it wasnt in time. i guess i will assume that my Validation letter is timely and valid since it was postmarked and CMRR on the 30th day. the thing is, they started reporting it to the bureaus at right about the same day they would have received my validation request. so technically, they shouldnt have reported it until they gave me validation.... i feel like im not making sense due to my longwindedness..... b
  5. Thanks, I will use the letter. I will threaten to sue for reporting during the 30 day Validation period. But im still worried about my timing of the DV. By my calculations, it looks like i got it postmarked on the 30th day. and it wasnt delivered to them until the 32nd day. Does that make it valid? Also, the repeated bill collector calls appear to be coming from "Diversified Consultants" a specialty cell phone bill collector. It looks like they may be affiliated with Midland? these people are scum. they are calling right now. Does this mean they will be slapping me with another CA on my report? I sent Midland a Cease and Dissist in my letter, so now its these people calling. thanks

Im in the process of a mortgage. obviously this set them off for VZW. but thats another thread. i just want to get your opinion on my next steps. on 2/14/13 i received a collection letter from Midland credit (MCM and other variations) for an old VZW account that i refuse to pay, its wrong. $574. they make some stupid offer and give me 45 days to respond before they take action. I had a brainf@rt and let it slide, although the 45 days struck me odd. but i was busy heading on vacation. i figured i would give it some time and send my DV around the 30th day, thinking i could drag this out and keep it from hitting my credit during my mortgage. so i get home from disney, and it's 3/16. all of a sudden, it hits me like a brick. what was i thinking? 45 days? so i got the letter and reread and sure enough, the fine print details state 30 days to DV. What was i thinking!!??? I know it's 30 days.... This is a Saturday almost noon. I freak out and get on here for a DV letter. I have my wife find 1 post office in the whole area that is open till 3pm. i hastily tailor a stock DV and do my best. I date the letter 3/14. My opening sentence states "I am sending this letter to you in response to a notice from you, dated 2/14/2013, which I received on 2/16/2013." Then i mail it 2 day delivery with the green card, from east coast to west coast. So i dont know if this is considered a timely DV request? They immediately slapped the account on Experian on the the day after my DV got delivered. then a couple days later, they hit EQ and use a slight variation of their name, and a slightly different amount. Then a day later they hit TU and do the same thing! Im worried this makes it look like i have 3 separate collections for 3 different amounts! So, if the DV is valid, they shouldnt have put this on my reports? next i get a letter from them telling me: "04-04-13 We have opened an investigation concerning your recent request and have requested the appropriate documents. A consumer support services representative will provide a response to your request in the near future. We can be reached at, blah blah." (and my dv had a cease and disist all communication except mail, and they keep calling and i dont answer) I ignore this letter and the repeated phone calls. today, i get another letter: "April 5, 2013 In a previous communication with our company you indicated that you were being represented by an attorney but attorney contact information was not provided. Please provide the following information so that we may contact your attorney directly." blah blah.. I never said i had an attorney... all is said is this: "if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel. This includes any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is." I did not say that i had legal counsel handling this matter. i said in future tense. if i had attorney, he would have written the letter!! so what should i do? ignore? 30 days from my DV would be around 4/16--if my DV is considered valid?. is this just a stall tactic? I think i read somewhere that a response will start the clock ticking again or end my rights or something? I just counted the calendar days from February 14 to the day i mailed the DV on 3/16, and that is exactly 30 days. it was postmarked on the 30th day. just remembered that feb only has 28 days. now is it a valid DV? or does it need to be delivered within 30 days? Please advise!! sorry for the novel...
  8. redcard is my oldest and only cc... i have had it si ce 2007. they have never given me a cli. my limit is only $500. i called a couple years ago and they told me i can't request cli. they review periodically and automatically issue cli. i have never been late, not once. i gave up...
  9. my worry is that it is a new collection account on my report. i was under the impression that all lenders pull again before closing? also, when they sent me the original commitment letter almost a month ago, it was full of all kinds of generic conditions like complete a new home owner wotkshop, and a bunch of other silly stuff along w paying off vzw (no ca at that time). but when i asked about tbe conditions, the lo kinda made light of them and said she was trying to get them "waived", and i would be receiving emails telling me what they needed from us. she never again mentioned those conditions. and i have been hesitant to bring them up again. it seemed sorta like a boilerplate commitment and i got the feeling they quickly generated it bc i kept bugging them about it... but loan still has to get final buyoff from underwriter this week. the appraisal was just finished Friday. they said it was no problem and closing wouldn't be late. so im wondering if this is when the underwriters may do a second pull...
  10. wonderful. sure enough, Midland hit my credit report today:( 5 days befor closing. I am so upset. i could hang myself (not literally)... a$$holes. here is the deal-- the collection letter they sent me was dated Feb 14 at the top. the letter said something about "get in touch with us before March 31st to settle this debt before it negatively impacts your credit rating." Like a dumba$$, I wasnt thinking, and thought i had til the 31st to DV. I was on vacation last week. when i got home it was the 16th and i read the letter again. Suddenly it hit me that 30 days to DV was likely the 14th!!! so i wrote the DV and said that i received their letter dated the 14th, on the 16th. I had it postmarked and mailed it immediately, on the 16th. Well today, the 24th, the Collection appears on my report. i am so upset. I'm sure Wells Fargo is going to pull my credit again before closing? Why couldnt this have waited a few more days?!! This is absolutely ruining my whole life. And its past the SOL anyway! I will NEVER use VERIZON again. i wish i could do something to get even with them. I wish i could hurt them like they have hurt me. over $500. any suggestions?
  11. Acct is 4 years old. I'm sure they saw I was applying for a mortgage. They sent it to Midland who started calling immediately. I knew how the scenario was going to work, and sure enough, it is just what I thought. I was approved for FHA w CONDITIONS, w the bad Verizon acct on my report. the collection agency is NOT reporting yet. The condition is of course to pay off the Verizon acct in full and verify the payoff. I believe the condition says they need to see it reflect on my credit report, which seems impossible by my closing date of 29th... So how am I supposed to fix this wo screwing my mortgage? I guess VZW is gonna start reporting as a charge off. The CA says if I don't pay by 31st, they will report it. So Wells Fargo wants me to pay vzw and don't yet know about CA. I was thinking about waiting until around the 22nd andsending DV to postpone them from reporting for another month, but this won't help me w the OC tradeline. Can I pay OC at all? Any suggestions? I have come so far and finally thought I could buy a house. I HATE VZW and will never use them again. This was a mistake on their part and they would not believe me. I refused to pay. It's blackmail.
  12. thanks Lynn. if i pay it now, can i settle for less, or dont even argue? i can pay it but it will sting a little. if i pay quick enough is it possible to avoid it reporting on credit? do pell grant overpayments go on caivrs? it is not reporting on credit yet. im scared it will report as paid collection and my scores will tank... would there be any way or benefit to having it return to doe? thx, b
  13. i started this thread in the credit forum, now it is getting specific and need to move: http://creditboards.com/forums/index.php?showtopic=503568&st=0&gopid=4775962entry4775962 so i am in the middle of the longest real estate deal ever...im working on my second lender. now i get a collection letter from West Asset, for a Pell Grant overpayment. it is only $640 including fees. i dv'd. they sent proof and simuoltaneously sent another letter stating i have not yet responded to their 1st letter. this is NOT reporting to cra's at the moment. i also had a clear CAIVRS as of about 3 weeks ago. at first CAIVRS was bad, and i had to pay off $1700 loan to clear it. i have been working diligently on all these loans for over 2 years now. I rehabbed a bunch of loans. I was not aware of this outstanding loan. I had so many it was so confusing! FHA said they would guarantee my mortgage if I paid that student LOAN. so CAIVRS was cleared. then the lender denied my mortgage because of a conflict in statements that I made, about large cash deposits in my bank accounts (BS). but now I have all that fixed and my file is good to go according to the broker. now I am with a new lender. on October 13 i received the first collection letter from West asset management. So i asked my broker to check CAIVRS again. they said it was still clear, about 3 weeks ago. so, I need to keep this from appearing on my credit or CAIVRS, in the next month or so, at the least. I guess my first question would be, do Pell Grants report to CAIVRS like student loans? then, what can I do to prevent this from hitting my credit report? do I simply pay West asset? can i use some technique to stall them while my mortgage is processing? I really need to avoid this from showing up altogether, because there is a good chance this deal will fall through. then I will be looking for another house. and will no longer be eligible for a mortgage if this appears. as it stands, West asset is waiting for me to contact them. how long do you think I have before this shows up on my credit? I can pay this in a lump sum if necessary. if I contacted them and set up some type of payment arrangement, could that theoretically delay any credit reporting? I guess I'm concerned that if I pay them in full, they will slap a paid collection on my credit... like I said, at the moment nothing is reporting on my credit. I hope someone can give me some logical advice today, as I want to take care of this as soon as possible, before it turns into something else and ruins my years of work towards a mortgage. thanks
  14. yeah, i was preapproved back in august. signed a contract in september, got all the way through underwriting and had a committment from lender, then their quality control "randomly selected" my file. loan was denied bc i they didnt like my "cash on hand" story... which was true. so now i got "gift letters", and a new lender. yhis has been the longest closing ever and the seller is ready to bail. so it appears that WA is collecting for doe and everything looks legit. should i call usde and inquire? again, this is not reporting on my credit yet, and as of 2 or 3 weeks ago i had a clear caivrs. so i wonder if PELL GRANTS report to caivrs? PELL GRANTS are NOT loans... i just need to figure out how to stop this from interfering w my mortgage thats already in progress. if that pops on my credit i will be screwed. i dont have a good feeling about this desl and definitely wont get another desl if this shows up so how do i keep it off? pay them? will it show up if i pay? HELP!!
  15. ok, i was ready to send the followup dv letter, and i checked my mailbox. they sent a big manilla envelope with the proof inside, that it belongs to me. it was a pell grant that was overpaid and i dropped out of school. I am not certain that i did not already pay it back though. I have been cleaning up these confusing usde loans/grants for 2 years now. i rehabbed a bunch of loans and paid off everything that was found on CAIVRS recently. FHA agreed to guarantee my mortgage if I cleared CAIVRS, and i did. The mortgage broker reported that I now have a clear CAIVRS. when i received this first notice from West Asset, I got worried and told my broker that i "may have paid the wrong student loan off", and please check CAIVRS again. he did, and it was still clear. Do PELL GRANT overpayments report to CAIVRS like loans? so it appears that this is genuine. luckily it is only $640, and i can pay it. the original amount was $562. It is not reporting on my credit as of now. I suspect they sent the 2 responses to me simoultaneously, one was the dv response in a big manilla envelope, and the other was the one stating that i have not responded to them, which i received first. I guess the manilla envelope with the dv proof was supposed to be delivered first but took longer for some reason. So what should i do to avoid this on my credit during my mortgage? I really dont want to shell out $640, but whatever it takes. maybe 3 payments? I hate dealing with a CA. Perhaps they dont know that it is not on my credit? i was successful at disputing a bunch of these it the past. I just kept disputing them over the years and they disappeared eventually. i guess since i recently paid off some loans, they woke up... b
