I have been emailing and calling the contact person at the DOJ. She assures me she is going to send me a copy of the judgment but I still have not received it. I spoke to my mortgage broker this morning and he told me that I have to call HUD. I called HUD and they said to call FHA. I called FHA and they said only DOJ can clear this issue. If CAIVRS is acting as a credit reporting agency don't they fall under the FCRA? Why can't I speak to them directly or see the copy of the CAIVRS report? FHA customer service rep said they are a federal credit reporting agency and work under different guidelines. I don't remember seeing that in the FCRA. Can someone let me know if I'm wrong on this? @DallasLoanGuy once I receive the copy of the order from DOJ who do I give this evidence to so it can be overidden? I'm getting the runaround by everyone including Quicken.

Hi Icanhasmuny, I finally got someome at DOJ to help me. It's my social with someone else's name. DOJ person said its from a database called CAIVRS. I don't know how to proceed with this as DOJ is the only one who can remove it and I am unable to contact CAIVRS directly. I called FHA and they informed me that they are unable to clear it even it's an error. That's crazy. Oh and the best part is that it's a judgment from a crime committed in 1997. I don't even know where to start with this as I told the DOJ person that I have never been in any trouble (other than parking and traffic tickets). I hope Quicken loan can help me.

Good afternoon, I'm in the process of applying for a mortgage through Quicken. I thought all was going smoothly until I received a message from my agent this morning saying that they "found something under my name that is a deal breaker and it's from the Department of Justice". I have never heard of this so I became curious. He gave me a case number and a number to call and when I did call it was the U.S attorney's office in Newark. The clerk asked me to send her the "judgement search page" so she can answer my questions. My agent is being very mysterious and secretive and will not give me much info. He says his underwriting team is working on it. Has anyone encountered this issue in the past or can direct me to where I can find the judgement search page myself? I want to know what this is regarding as I have never had an issue with the DOJ. What database are the mortgage underwriters using to find this judgment that I didn't even know existed.

Happy Saturday to all! I have a question concerning New York University also acting as a collection agency to collect on unpaid tuition. I remember reading somewhere that it is against NYS bonding rules for creditors do this. I do not believe they are a legitimate collection agency. They report to the credit bureau as National Credit Systems with the same address as New York University's main office. Can someone please let me know if I'm wrong on this? Thanks.

Good afternoon, I tried looking for this topic on the board but did not find an answer. In NYC the IRS and NYS Tax reports liens to the Department of Finance. Does anyone know if the Department of Finance report to the credit bureaus. Thanks in advance! MJL

I wish that was my only problem. The point of the matter is does Experian have the right to assign me one person which I cannot access most of the time. Is this a violation of the FCRA? -
Good morning, I have posted in the past about this topic but was not sure if I'm on the right track. I want to take Experian to court for assigning me to Carla Blair due to a federal complaint filed against Experian in 2003. I can only speak to this sole individual whose phone always goes straight to voicemail. I have to wait three days to get a call back from her. I have my mortgage pre-approval letter on hold because I cannot get the current balances of my credit cards updated until Ms. Blair calls back and then when she does she purposely drags her feet in her "investigation" even though I have provided her the necessary proof. I am not allowed to speak to anyone else at Experian except for her. God forbid she's on vacation or out of the office for a week. I feel like this is a blatant violation of FCRA Section 612 (a)(1)©(III) which states: "the ease by which consumers should be able to contact consumer reporting agencies with respect to access to such consumer reports". I have posted the entire subsection C below. © Nationwide Specialty Consumer Reporting Agency (i) In general. The Bureau shall prescribe regulations applicable to each consumer reporting agency described in section 603(w) to require the establishment of a streamlined process for consumers to request consumer reports under subparagraph (A), which shall include, at a minimum, the establishment by each such agency of a toll-free telephone number for such requests. (ii) Considerations. In prescribing regulations under clause (i), the Bureau shall consider– (I) the significant demands that may be placed on consumer reporting agencies in providing such consumer reports; (II) appropriate means to ensure that consumer reporting agencies can satisfactorily meet those demands, including the efficacy of a system of staggering the availability to consumers of such consumer reports; and (III) the ease by which consumers should be able to contact consumer reporting agencies with respect to access to such consumer reports. Can someone please give me their feedback if I am interpreting this correctly. Thanks!

Good evening everyone, looks like Experian is up to their old tricks again. We have a contemptuous relationship to say the least. I successfully sued them in the Southern District of NY in 2002 and things have never been the same. Fast forward to 2015 and I filed a small claims complaint for minor, annoying violations over the summer and I have now been relegated to only speaking to Carla Blair (of the Blair Witch Project). I find this irksome that I can only speak with her and when I call the toll free number my Experian file is blocked and I get transferred to Special Handling and even they can't help. I believe this a violation of the FCRA as it states that consumers must have access during certain times of the day to customer reps at the CBRs. Forcing me to only speak to the nasty and curt Ms. Blair does not constitute "access" in my book. Am I incorrect in believing that this is a major violation? Thanks. Martine

Yes, this is the same thing that the attorney at the credit union told me. We have court today. I have been going through the FCRA duty of furnishers and it's not clear if they have to mark it in dispute if the dispute was filed with the credit reporting agency. I have been disputing the tradeline for a year now. Does this apply to my credit union: Section 623(a)(3) - Duty to provide notice of continuing dispute This section applies when a consumer has disputed to the creditor or other furnisher of information under Section 611 the accuracy or completeness of information that the creditor or other furnisher of information has furnished to a consumer reporting agency. If the consumer continues to dispute the information, then the creditor or other furnisher of the information must include a notice of dispute whenever the information is furnished to a consumer reporting agency. According to an FTC staff opinion letter, a furnisher may, upon receiving a notice of dispute, cease reporting the disputed information while it investigates the matter and then either (1) correct the information if appropriate or (2) report the item as disputed by the consumer where that is the result of the investigation. Good morning all, long time no speak. I have an upcoming courtdate with my credit union in NYC for having incorrect information on my credit report. I was always under the impression that the data furnisher has to mark the tradeline "in dispute" if a dispute is filed with a CB. However, the snazzy and alert attorney at the CU pointed out to me that there is no such thing in the FCRA (yes, she actually read it). She told me that the credit union only has to investigate but they do not have to mark it the tradeline "in dispute" during the investigation process. She has agreed to remove the late history if I can point that out to her. Can someone please direct me to where this is stated in the FCRA? Hi there, LVNV is one of the toughest CA's to remove from your CBR. I have filed complaints to the S.C. AG office, the SC BBB and a host of other complaints. What finally caught their attention was when I filed a small claims complaint against the original creditor although the debt had been purchased by LVNV and the OC was no longer in the picture (it was not assigned but actually owed by LVNV). So, if you want to fast forward all the disputing with them just do this and it should work. My OG was HSBC and the woman in their legal dept was very helpful. This will only work if you have paid the debt, btw. Good luck.
