My husband and I filed Chapter 7 and were discharged on August 26th 2010. I have checked my credit reports, and all my private student loans show up as $0 balance and "included in Bankruptcy". My federal loan still shows up on the credit report and states "in deferment". I also logged on to AES's website to check on my balances there. Two of my loans have a $0 balance on there. One states "paid in full" and the other "claim paid". All the others say "repayment" but when I go into details view it doesn't have a date in the "next payment due" space. These were all TERI loans, if that makes a difference. What do you think is going on? Did they actually get discharged?

If they were actually discharged, count your blessings.

 

Bankruptcy judges are reluctant to include them in Ch 7 as they believe you got an education in exchange for the loan.

 

Keep your fingers crossed.

I can assure you they havent been discharged. AES sometimes works in conjunction with another lender with private loans so a default claim may have been filed, resulting in a a zero balance. Or they simply just have not updated yet...it has only been just over a week....give it time.

My AES Teri loans entered an automatic 6 month forbearance once I filed. The online access said $0 due and had no date in the due date for that entire time.

 

Right before the 6 months was up I got a letter informing me that my loans were gong to enter a 6 month forbearance due to the bankruptcy and a letter letting me know the forbearance was over and my new due date on the same day.

 

They were able to give me the forbearance and future due date information by phone roughly a month after I filed.

 

Unless you filed an AP against your student loan lender, your student loans were not discharged -- no matter what your credit report says.

Have you found out anything yet? Do you owe them? I'm in the same situation. My credit report also shows a zero balance and shows included in bankrutcy.

I was under the impression that if you filed bankruptcy that they would go into default. (if they hadn't already). I think it's very, very rare for Private SL to be included in bankruptcy. It may look like they are, but I am pretty sure within a few months that it will show you still owe.
