Hi to all,

We have been in the process of short-selling our home for the last 4 months. (We have felt this to be our only recourse because our lender would not work with us) Our realtor has been in close contact with the lender throughout the process. Lender has turned down both offers holding out for more money.

 

Meantime, apparently lender has proceeded with foreclosure and (knowing we now live 3,000 miles away) mailed paperwork to our house address about a court date. The court date came and went, we never knew about it and assumed that if this process were in the works, our Realtor would have been informed and we would have as well (at our current address).

 

The default judgment final court document was mailed to our "correct" address. Was this done on purpose so we would have assuredly missed the court date? Our realtor is not sure how to proceed at this point either.

 

We found out that we qualify for the HAMP program, we have requested the application from the lender twice in the last month and have received NOTHING from them.

 

We advised the realtor to proceed with the short-sale pending the outcome of the HAMP application

 

Is it too late to do anything? ideas? Sorry if this sounds messed up because that's how our lives have been the last 6 months.
