I have 5 properties that were foreclosed on that have an HOA. 4 of them are in the same HOAs.

 

One property was sold at auction in June 2008, and the other 4 were sold July 2008. I have sent so many letters to all the HOAs telling them we are no longer responsible for the dues, the bank is- but they keep on sending letters with growing fees. They even put liens on the properties with our names on it in September 2008- we haven't owned these properties since July, and the bank changed the locks in May! They also still charge us the water bill for each of the 4 condos.

 

I have now printed out the copy of the Trustee's Deed, highlighting the auction date. What else should I do to get them to stop charging us fees?!

I had the same prob, If U did Bk have the lawyer write them a letter it worked wonders for us. If you did not do BK send them what you outlined with a letter that states the Bank (name) is new owner forward bill to them with address and info of as of date. My lawyer did that and it did wonders for us.

Ignore them.

 

The ongoing fees and costs are the responsibility of the owner, and you are not the owner.

 

Send them a letter (CMRRR) putting them on notice that you are no longer responsible for ongoing fees, and will be keeping a log of all of their contact attempts, for later use in a harassment claim.

 

Some salamander property manager is trying to get the fees paid by anyone who will take responsibility for them, as the HOA's cash flow is down from the general increase in fee delinquencies.

 

If they have a problem with the new owner not paying ongoing fees, tell them to lien the unit and leave you alone.
