A paid medical collection just appeared on my CR. This account is from a workers comp case from August 2006.

 

In Oct. 2006 I received a letter from the hospital stating the account was past due. I spoke to the billing department, advised them it was workers comp and gave them the claim number. I then called the comp ins. carrier and spoke to the claims adjuster, who advised the hospital failed to supply the correct diagnosis code and they were attempting to get it corrected. I then called the hospital back and spoke to the billing dept again and advised them what the problem was. The more than helpful clerk told me that she would send out the correct code.

 

On Dec. 20, 2006 I recieved a dunning letter from some CA. I immedaitely called the workers comp ins carrier and was advised by them that the check was mailed to the hospital but not yet cashed. I called the ins. carrier the following week and they told me the check had cleared. The payment address on the dunning was the hospital, so I just left it alone since I knew it was paid.

 

Today I check my credit report and there is a paid collection acccount from CA, stating the collection was paid in full in Dec. 2006

 

How do I get rid of this? Can I sent th hippa letter, I don't know if I can since it is reported paid, however i did not pay it. Agghh - Just when you think you're out, they pull you back in.

Delete old addresses

Send medical dispute letter(below) to CRA's reporting this medical collections. Wait for the full response(30+5 days) before proceeding to the next step. You may just get a deletion with the dispute letter.

I spent the better part of the weekend researching this and resolved it with the hospital this morning by threatening lawsuit. For those of us in NY, it may be worth noting that it is illeagal for a medical provider to collect from an injured worker on workers compensation claims.

 

New York Workers Compensation Law Article 2 Section 13-F

 

§ 13-f. Payment of medical fees. (1) Fees for medical services shall

be payable only to a physician or other qualified person permitted by

sections thirteen-b, thirteen-k, thirteen-l and thirteen-m of this

chapter or other authorized provider of health care under the education

law or the public health law permitted to render medical care or

treatment under this chapter, or to the agent, executor or administrator

of the estate of such physician or such other qualified person. Except

as provided in section thirteen-d of this chapter, no provider of health

care rendering medical care or treatment to a compensation claimant,

shall collect or receive a fee from such claimant within this state, but

shall have recourse for payment of services rendered only to the

employer under the provisions of this chapter. Any compensation claimant

who pays a fee to a provider of health care for medical care or

treatment under this chapter shall have a cause of action against such

provider of health care for the recovery of the money paid, which cause

of action may be assigned to the chair in trust for the assigning

claimant. All such assignments shall run to the chair. The chair may sue

the physician, or other authorized provider of health care as herein

described on the assigned cause of action with the benefits and subject

to the provisions of existing law applying to such actions by the

claimant himself or herself. Hospitals shall not be entitled to receive

the remuneration paid to physicians on their staff for medical and

surgical services.
