I have a medical collection showing on all 3 CRAs. Pre-CB I paid the CA. I tried nutcase, and all that got me was a letter stating that the account was paid in full (at the time I did not understand that I should not communicate with the CA).

 

Where do I go from here to get this thing off my reports? It was for a stupid $114 for a dentist. Is it too late to HIPAA the dentist?

MEDICAL COLLECTIONS DISPUTES LETTER

 

Attention: Account Manager (legal department)

 

On [DATE, 2006], I wrote you regarding alleged indebtedness to XXXX, Inc. In that letter I made a timely request for validation of the alleged debt(s) under the provisions of the Fair Debt Collections Practices Act (FDCPA) and requested specific information under the Health Insurance Privacy and Accountability Act (HIPAA). Please be advised that this is my second request for the following:

1) Letter of sale or assignment from the original creditor to your company. (Agreement with your client that grants you the authority to collect on this alleged debt, or proof of acquisition by purchase or assignment.)

2) Agreement that bears the signature of the alleged debtor wherein he or she agreed to pay the creditor.

3) Documentation that substantiates what the alleged debt amount you affirm the alleged debtor owes.

4) A full written accounting history, beginning with the original creditor, explaining and demonstrating exact calculations of the alleged debt amount, which also demonstrates a detailed billing for any and all services rendered.

5) I furthermore request the name, address, department and phone (including any extensions) of the original creditor who is stating that this alleged liability belongs to me, along with the doctor(s) names who performed any service to which this alleged debt is for.

6) Proof the Statute of Limitations has not expired on this alleged account.

7) Proof that you are licensed to collect in my state in addition to your license numbers and Registered Agent.

 

On [DATE], I received your reply. The ‘‘invoices’’ provided appear not to have been obtained from the original creditor as required by FDCPA § 809(:blush2: and seem to be merely an unwarranted attempt to create a ‘‘stated account’’ condition. They do not provide appropriate verification of the alleged debt, nor do they provide any information as to what services were provided or for what activity support was being given. The validation materials provided are insufficient to verify the indebtedness, do not comply with the requirements of the FDCPA, and are not responsive to my requests.

 

To protect my credit worthiness, I am submitting this letter under the Fair Debt Collection Practices Act (the “Actâ€). Accept this letter in accordance with applicable federal and state laws governing fair debt collection practices. Take notice I am denying and disputing any amount you allege I owe to XXXXX, Inc. I'm sure you are aware, under FDCPA Section 809 (:(; you are not permitted to pursue collection activity until the debt is validated. You should be made aware the courts have ruled that reporting a collection account indeed is considered collection activity.

 

I require compliance with the terms and conditions of this letter within 15 (fifteen) days or a complete withdrawal, in writing, of any claim. If in fact, upon your investigation, you find that you have misrepresented the information that you have reported on my credit report, you have 48 (forty-eight) hours from receipt of this notice to completely and permanently remove and delete your listing from any credit reporting agency or depository regarding this account. In addition, I am requesting a formal letter of apology stating such. If, and when the accuracy of this liability is legally proven to be valid, it will be my intention to rectify it post haste. Thank you for your cooperation.
