Okay, I was stupid.

 

I registered for classes after being told by my Financial Aid advisor that my financial aid would come through. I specifically said I would not sign up if it would not come through, they assured me it would.

 

It never did.

 

I was never able to buy books, withdrew, etc. Filed grievance to get tuition forgiven, denied.

 

Collection agency after me for 2,969 bucks.

 

I registered for classes in December of 2002. Is registration for classes considered a written contract, or an open account?

 

Also, the FDCPA says:

 

"(2) in the case of an action not described in paragraph (1), bring such action only in the judicial district or similar legal entity—

(A) in which such consumer signed the contract sued upon; or

(:grin: in which such consumer resides at the commencement of the action. "

 

If it is considered a contract, they can sue me in New York, where I do not live, and can do so until December 2008, correct?

 

If it is not a contract, though, they would have to sue me in Arkansas?

 

Am I reading this rightly?

Also, on Experian, they are reporting it as an installment account, which it never was. A student loan is an installment account. Tuition accounts, I would think, would be revolving, since you have tuition, pay it, and then add more tuition and pay it again, or an individual account -- never an installment. This is lowering my Experian FICO by 30 points.

 

Basically, does anyone have any help for me on this?

 

I probably don't want to awaken the sleeping beast, but I have never received a dunning letter from this collector either.

If you attended school in NY, and it was a state school (college or university), your tuition is considered a debt to the state and will never go away. SOL's do not apply so even if you manage to have it disappear from the cra's, it will always be a sleeping giant.

 

Why did your financial aid never come thru?
