  1. Hello everybody! It's been awhile since I have posted anything on this board,but I still browse from time to time. Here is a question (I am rusty) about collections. I am trying to assist a neighbor with his credit report and he is dealing with two accounts that Asset Acceptance has picked up. Of course,they are reporting them on his credit report incorrectly(the usual way they report). I have disputed with all CRAS and they have "verified" that the accounts belong to my neighbor(as always). I have disputed the balance,DOFD,DOLA,the reporting of it being "past due" with an amount showing.We have filed complaints with the BBB in Michigan and requested schedule A,showing that they are the owners of the accounts,which Asset Acceptance sent back something with his name on it and xxx-xx- as his social security number.I am not sure if they typed this stuff up or if it is authentic. My questions are as follows: There was one payment made a few years ago,but it did not make the account current.Under Texas law,does this restart the SOL? Asset Acceptance wrote on the letter to the BBB that,due to the accounts age (opened in 2006),the contract is no longer available for them to retrieve.If I am requesting the contract(application or agreement) and Asset Acceptance admits to not having access to it,is this something I can make an issue out of? Thanks!

  3. I could have sworn VA loans weren't score driven.I will check back because we have a VA loan(7 years ago) but I don't think it was really about the score...

Oh I do understand all the regulations but I am still not sure that it legal to show that is it still a past due amount on the account reporting with no other update.The account is 5 years old but he must have a payment agreement due to his job as a military contractor and clearance issues.He works with my husband so I took on the opportunity to try to assist him.Now he has been making these payments but as of late,the OC has added additional money on the credit report as being owed and past due.
  5. Pretty much what a settlement is is a new agreement or am I not correct?
  6. I don't see how reporting no payments have been made or past due when their is a binding agreement as being correct on the credit reports.

I read the settlement letter and the installments over several months and he asked if they would update the account to show that it is no longer in past due status and that the new balance of the new agreement be posted on his credit report.I would think that if a new agreement is offered,by posting the old balance and past due,would be false information.The person who is handling his account informed him that they will not change the status of his account....
  8. Hey everyone,long time! I am helping a person with his credit report and can not remember if a O.C. who has offered a settlement for less than the amount of the account,but the settlement is being paid by monthly installments,is required to report the new agreed balance ?
  9. As per their very own website," Experian cannot remove accurate information or information verified by the source as accurate."They pretty much tell on themselves,smh!
  10. I was leaving this along but to state the fact of me "complaining" is unjust. I stated my experience and I am not the only one..just google it for yourself.
  11. I never said it never mattered. I said that from MY experience it did not work. Just like the BBB who really has no real power doesn't always work. Has the BBB worked for me?Yes,on most events. Has the BBB worked more than the A.G. with ME?Yes...in most events. You tell me Asset Acceptance is still on Earth,doing the same tactics in Michigan and are still in business?How many complaints does it take for the A.G. to move in?In my case,deletion is what is needed because the account is not ours.You have to present this in both cases because just because one A.G. decided to handle it,don't mean another will. From what I read,companies like Asset Acceptance dish out money to these political events and this is why they get away. I am not going the political route,but I am only stating if they know how to bribe,they can get a slap on the hand.

Unfortunately (and to be quite blunt) it's attitudes like that is why the AGs don't do more...First of all I am not a newbie.Secondly,just because it didn't work for me,does not make me wrong for stating so.Like I said,I am not here to argue but it's a fact when I see the paperwork in my hand from constantly complaining to certain state A.G.'s,they do not really do much.Guess what, I have about 10 letters from several A.G.'s and I have went out my way filing certified letters with 50 pages of evidence over and over. Faxing stuff with actual proof over and over until now,I am filing lawsuits. You can't speak for everyone's experience and your "bluntness" was totally uncalled for. This is a forum that we share our experiences and I shared just that,simple as that.
  14. My husband got denied an P.T. over a collection account under dispute. It is close to the same paperwork he has to go through as other clearances. They have caps of how high a amount of debt can be waivered...Altho they are giving him a chance to get it resolved and this is why we are suing....

I wondered lol I kept getting Vmail so I told the agent who answered that I wanted to speak to someone in that department , I was forwarded to a >Name< Man in same department and he assured me she would call in the AM and had to call within 48hrs, was supposedly out of the office. If she is in fact fake I will be pursuing it in the AM. Is she fake Sharnese? I'm gonna guess that is who you have ,lol???Put it like this,this week Anna Simmons and Experian along with one other company is being handed a court summons by us,lol...that's how bad she is. She is a real person alright,a real pain in the azz! Can she be dealt with? and will she remove incorrectly reported accounts? I really do not care either way as I am not dependent on credit, if shes not willing to uphold the law and Mediate to reasonable resolution I will just continue filing complaints and continue escalation.. hell my credit has sucked since college when they started re aging this crap,couple more years that end in profit will not kill me,hopefully if she is useless you can request a new account contact I sent you a PM
