  1. Well the lawsuit docs were "served" today. It is on credit card debt that is still several months inside of its SOL. Just as a review: "A friend is divorced and on Social Security disability. He lives with a relative and owns one car. His only items of possession are older household furniture and a 15 year old TV. He has some several-year-old credit card debt remaining and some medical debt. It would seem he is judgment proof." Now that he has been served and since it would seem he is judgement proof what is the best way to proceed? Is there a way to move forward and deal with the lawsuit without hiring an attorney? Thank you.
  2. I checked county court records and there is nothing listed there. On his first visit the process server said it was from B of A.
  3. The date of last activity was actually in the Fall of 2013. (If he is "uncollectible" does this also apply to some of his disability funds in his bank account?)
  4. Mendelssohn: The CC debt is 4 years old and is in Texas. You suggest avoiding BK and laying low, but what is the best way to deal with what the process server is trying to deliver? Thanks!
  5. Yes, this process server has shown up to the door but someone else answered the door the service was not completed.
  6. His credit card debt is less than 7 years old. He's getting no calls or letters but a process server has been attempting to make contact. His hospitalization debt is roughly 2 and 4 years old. Thanks Icanhasmuny!

Would he be wisest to declare bankruptcy or should he just muddle on through dealing with each debt item as it arises? Thank you

  11. If I were to lower the credit limits on our credit cards and then put a security freeze on my credit reports would my wife be able to raise the credit limits back up? It would seem that the credit card company, being unable to access my credit reports, would deny an attempt to raise the limits back up. Thanks
