  1. Oh and thank you for all the info that is on this board, the one thing I found as the best advice is to make your letter fit the situation and as they say on American Idol "Make it your own" lol
  2. I have 2 credit cards in good standing, a car loan thanks to a GW letter in good standing as well as 3 other cars payed off in good standing, and a mortgage in good standing, and a couple of personal loans payed off in good standing I only have 2 inquiries in EX, 1 on TU and 1 on EQ. I wanted to wait a couple of months and see what my scores do then before i apply, i did not want subprime or a low rate card if i did not have to, I just thought it would look better if they were not there, not that anything is wrong with them after all that is how my credit got started to start off with, like I said i have a couple of things to deal with yet and just trying to figure the best approach to take and then apply for cards, maybe I am way off base on my plan but with a little brain this is what i see as my best approach to take
  3. @ deshon1881, on all of my tradelines I send only 1 Validation request, Enhanced did not respond LVNV did. I then sent a letter to them stating that basically they have not done there job according to the law and they have left me with no choice but to file a complaint, dated today with the following, My AG, there AG, the BBB, the FTC if applicable (and it was), and a copy of this has been sent to each of your board members. On day 16 from the date of this letter if these tradelines are not removed and this account is not closed in your files to never be sold or placed with another third party debt collector or attorney I will be forced to take legal action against your company, I assure you I do have all of my paperwork in order. @catindebt, A couple of the GW were open and the rest closed, I sent them non CMRR but Priority. What i did do was send a GW letter to there general addresson day 1, the next day I sent a copy to there dispute dept, on day 3 I sent one to a high ranking CEO of there company, on a car loan i had a couple of years ago these did no good so I sent each of there Board Of Directors a letter and got a letter back from him saying we are sorry to hear of your hardship, bla bla bla and our company, as a rule do not do this but under the circumstances will be happy to remove these from your credit report. You should see them gone in 30 to 45 days. We look forward to you doing business again.
  4. 2-LVNV Removed 3-NCO Removed 5-Lates Removed by GW letters 3-Medclear Removed 2-Credit Sys. Removed 1- Enhanced Recovery Removed 1-Harvest Assoc Removed 1-Capital Management Removed Now I just need to clean up a couple of items that are best left alone for now. When I started my credit score was 527 now it is 689. Thank you Mods for this board, though I am finished for the most part I will be back to work on DW report and help a good friend out
  5. What State are you in and was the account in that State? Do you remember about when the account was closed? For SOL reasons Yes you would like to keep it that way but, you have to do this in steps and they could reply in a couple of different ways, If you do not want it on your report and you know it is correct and true then send another letter when you get a response from your DV and offer to pay it BUT ONLY if they agree to it in writing, with the words We will accept your payment and close this file permanently and ABC Collection company will not report this to any CRA. Or If by then they have reported it send a letter saying I am not confirming this is my debt nor am I denying this is my debt, this is causing me hardship being on my report and in order for me to pay it you must agree to completely remove this from all of the CRA's and my file will be marked closed and will not be sold or assigned to another company for collection, simply put this is a closed dead file please respond by USPS and let me know what you intend to do. Or Go through the process of various letters till they fold See there is no way of knowing, even if it was my debt I would have to research the best action to take depending on the actual credit reports, you can't predict "what if" before it happens, I promise you it will drive you mad
  6. Yes, most were reporting wrong, some amounts were wrong, showed open not closed, reaged trade lines, and they responded to the first validation basically saying Yep! it's yours now pay, or they did not respond at all, not bonded in Tx. But yes they were violating the Texas Finance Code, some several times on one tradeline. Yes i did file complaints, and yes i do have the paperwork to back it up, including a copy of all correspondences i sent them, If you would like a copy of my first and second letters let me know. In the first letter i stated I want the 5 "W's" and "H" Who, What, Where, When, Why and How, Your company wants me to pay this alleged debt, and I want proof it is even mine and every entry on it is correct. As for the selling it to another CA maybe but In the second letter, hopefully what i put in it will stop that, then again maybe not. The GW letters were to a local bank in my town, Aames home mortgage, Litton loan servicing, GMAC, Security Finance and Discover, and Amex. I sent several GW letters to the same company but to different departments, i did not send the same company all of the letters the same day, i sent them 1 on Monday, 1 on Tues, 1 on Wed, etc...
  7. I was sending out the usual hit and miss validation letters with hit and miss success. After researching, I have discovered, as we all know that many CA's are or have been sued by many States AG's and class action suits in the last couple of years, so this is what I tried. I send the usual 1st validation letter. The second letter is informing them I HAVE filed a complaint with mine and there AG(Name of there and my AG), mine and there BBB, the FTC, as well as there Bonding company (There Bonding Companies name), listing the violations they have committed, and stating that I have the paper work to back up my claims. My wife does the SEC filings for a fairly large corporation and she suggested finding out who is on the Board of Directors and sending each of them a copy of the second letter as well. I sent the same letter to each CA. A couple of weeks ago I sent out 7 second letters to 7 different CA's. as of today I have heard back from 5 and all 5 are now deleted. It took me and my DW several hours to perfect both letters Now I just got a couple of more CA to get rid of, a couple of more lates to get rid of and a few medical collections As of today I have had 4 Goodwill successes and have had a total of 11 deletes. (4 deletes averaged 10 weeks to remove, and 7 took 2 weeks)
  8. Carroll Shelby died at the age of 89, for anyone that has no clue who he is just look at the Ford Mustangs, he took them to a whole new level with the Mighty Shelby Mustang. If I could afford to buy one single car, I think it would be the Old School Shelby, I think I could look at my debt ratio on my report and be ok with it. Prayers to his family
  9. Carroll Shelby died at the age of 89, for anyone that has no clue who he is just look at the Ford Mustangs, he took them to a whole new level with the Mighty Shelby Mustang in the 60's
  10. I have been reading and I have seen yes and no on my question My wife defaulted on a loan, it was sent to a collection agency and she started a payment plan with them, a year and a half later they send her a letter saying she met the guidelines for rehab while they had our loan and it would be sent back to the original company. This was many months ago and Nelnet started a new file backdating it to 2000 when the loan was taken out showing perfect credit. My question is, do they remove the old tradeline???? Because it is still showing, closed, sold, or transferred with lates still showing
  11. There is a tradeline on my report that is as followa I do not have the report with me but this is very close Opened: 05/05 Reported since: 05/05 Status: 05/05 Type: Installment Mo Pmt: $0 Recent Bal: $2600.00 High bal: $3000.00 Account history: Collection as of 05/05 and Charge off as of 05/05 What is with the 05/05 that are on here
  12. I got a phone call from the lady's attorney today and ask me about doing a deposition for them and to also let me know of course they need the originals, I will of course send them to him but I was also asked politely not to move forward with informing the CA about it by trying to repair my credit, I of course will not do anything to harm her case, she is the one that really has grounds for a suit. I assumed they were not bonded in Texas turns out they are under there parent company's name. The bill is about $1400.00 dollars and I know for a fact is wrong I have the last bill from the hospital, there is a $376.00 dollar difference that what the hospital says. The SOL is up on this, there are also 2 other violations showing on my credit report and they are showing as a factoring company, the hospital SOLD the debt to them, I have no knowledge on Factoring companies and will study it. Any suggestions without bringing her into this
  13. is it listed by the OC or a CA
  14. MODS if i have violated a rule i apologize, but i think this has been asked so many times and might answer a few questions The pdf link is a case that went before District Judge, it is a case involving employment BUT if i am understanding the laws correct it may very well set a presidence for for the company as a whole, it may also be leverage for us since they have already have a case for FCRA violations If nothing else the attorneys have given case law files http://www.courthous...3/29/esteem.pdf LexisNexis cannot dismiss claims that its background-check service violates the Fair Credit Reporting Act, a federal judge ruled. http://massprivatei....-willfully.html This was in 2009 Multistate antitrust suit against LexisNexis http://www.legalnews...inst-lexisnexis This is also 2009 http://valawyersweek...1-2077-million/
  15. I have one that is out of SOL for $800.00, I used that CA as a ginny pig for my letter, I am doing the same letter for this CA as well and sending the same people the same letters, something new my wife suggested and maybe it is the thing to do, we'll see
