MelissaD - I'm going to call the complex and ask them for the move-in inspection. I have a feeling that they may not talk to me and refer me to the CA since that is where the debt is but I'm going to try. I'll let you know what they say!! fdj - I understand what you are saying. So its just ok for the OC to write on their letterhead how much I owe and not substaniate how much they paid for Time and Materials to supposedly repair the apartment?? That seems like a ticket to charge whatever they want. It also said that I had a balance forward from the previous month but never stated what that was for. It just doesn't seem logical, but I'm new at this and you probably have more experience than I do

So how should I approach this with NCS, since they are a CA and not the OC. I'm not sure exactly what to dispute....the amount? Or maybe just a general, "you are reporting incorrectly" - Should I ask NCS to provide me with receipts for the cost of materials etc etc. This is kind of a different DV since its for apartment damages, so they say! I already dv'd NCS, and they came back with sending me my lease and an itemized bill with the apartment complexes name on it. Then told me that I need to send documents to prove that the OC is wrong. I'm just not sure what to even write, if it was a collection for a cc or cell phone....it be an easier response. This is just "different". Suggestions as to what to write back to them?

We will notify you via US mail of our decision regarding your request for a Kay Jewelers account within 20 business days. I bet that probably is a "No" So that's 2 declines out of 2 apps within 2 weeks, discouraging. I think I will stop applying until I can push my score above the present 615 EQ 598 TU. Glad you got it...keep going Well I guess it's not 2 declines exactly....I did get approved at Verizon for 3 lines, no deposit.

I am considering giving Kay's a try but I'm a little scared...lol I was turned down by Macy's last weekend so maybe I'll just wait. EQ is 615 TU is 597 I don't know EX. I think utilization is a huge part of credit score. I bet you would jump tremendously if you paid it all down!

That's great....I just started this journey. I had my first baddie removed a week and half ago - shot my score up 15 pts so I was hopeful. But I just got back a reply from a CA for a debt on apartment damages, this is going to be hard to get removed I think. I don't know how to prove I don't owe it because I didn't take pictures. They are charging me for new carpet etc etc. I was there for 3 years....and now they want me to pay for the full cost of new carpet, paint, blinds, and cleaning. I did make post about it, so hopefully I'll get some ideas on how to deal with this! I'm glad you were successful, keep it up

I just looked for a copy of the move in report and I don't have it, which is surprising because I have all of their documentation in a file. In 1/2009 I notified them i writing, along with my rent payment that I would be moving on 1/31/2009 (lease was in a month to month status). On 1/21/2009 I called them to let them know I would be returning keys on 2/1/2009 in which informed me that they never received a notice for me moving out. Nothing I could do about it because I didn't have them sign the notice. I simply submitted it with my rent. I said fine....what do I need to pay then -- they said Feb rent up until 2/21/2009. Well I didn't have it at the time because I was moving in somewhere else and wasn't planning on paying rent two places in Feb. However, I paid half of it on 3/6/2009 and sent them a check for the rest on 3/13/2009. They cashed the check on 3/6 but sent back the check written on 3/13/2009 saying the following: They cannot accept this as final payment due to having an outstanding balance and they sent out a move out statement on 3/12/2009, submit the full payment of the statement. First off, I vacated the apartment on 1/31/2009, they sent the move out statement more than 30 days after I left, which is against the law. Second, they included these enormous charges for damages. I sent a dv to NCS, and they came back with the rental agreement (not a move in report) and a statement of the move out charges on the letterhead of the apartment complex. NCS said that I didn't provide sufficient evidence and I must provide NCS with all documentation to support that my claim is valid. I think these charges for damages should pro-rated first off. Being charged for painting....after 3 years? Some of this could be considered normal wear and tear. So I guess my claim to NCS is that they are reporting incorrect balances, terms, and past due balances which I thought is a violation. I'm just not sure what approach to take with NCS -- should i just simply say, the accounting is incorrect? Or should I go another route?

Here is something I read about Ohio's Tenant Laws: 2. Pro-Rated Damages The second and more difficult issue is pro-rating for the age of an item. Carpet in residential apartments has a certain life expectancy. Even if the carpet was new at move in, and was so terribly damaged after two years that it had to be entirely replaced, the tenant should be credited with two years worth of wear and tear which the carpet would have sustained any way. To keep the example simple, let's assume a carpet with a five year life expectancy. The tenant ruins the carpet after two years at the apartment. New carpet costs $1,000.00 to install. The landlord's damages will be $600.00. If this case goes to litigation over the deposit, it sucks to be you if the tenant had a $900.00 security deposit and you kept it all thinking that you had $1,000.00 in carpet damages. The court will award the tenant $300.00, double it to $600.00, and then set a hearing to determine what the tenant's reasonable attorneys fees are. It can get even worse if the tenant forces you to admit that you don't know when the carpet was last installed before he moved in. If you can't establish before and after evidence of value, you have failed to meet your burden of proof and the tenant wins. So should I be asking for receipts for the value of the items installed in the apartment before I moved it so pro-ration could be determined? Even if I get the amount reduced, it still will be on my credit as a paid collection which is just as bad as a not paid one, right? If anyone could please help with the approach I should take....I would surely appreciate it. I've just started my journey with fixing my credit. I was successful with the removal of my first baddie last week! But this one's outcome doesn't look good for me

I sent a DV to a CA who is collecting for an apartment I used to live in. All the charges are for damages, however, I consider them normal wear and tear and these charges are quite outrageous. So the CA sent me a statement from the apartment complex, listing the charges they say I'm responsible for, as their validation. In my letter to the CA, one of the items I asked for was: 2) Explain in detail and show me how the alleged debt was calculated. Please include a copy of ALL original receipts, including those for Time & Materials to substantiate any statements of monies due from the original creditor. Basically I'm asking for receipts for all the repairs they made. I think that it is reasonable. After all, anyone can say...."you owe me this much for painting" I lived there for nearly 3 years, so it would be expected that they would need to paint and replace carpet because they use the lowest grade carpet that is out there. I do not have pictures and that is not good for my case, however, I don't think they do either. Listed below are the charges they say I owe: 1. Refurbishment Charges/Paint 2 coats on ceiling and walls due to cigarette smoke. $280.00 2. Refurbishment Charges/Replace carpet due to stains $643.78 3. Refurbishment Charges/Left garbage in apartment and balcony. I left one small bag of garbage in the kitchen and one on the balcony. $200.00 4. Refurbishment Charges/Kitchen appliances dirty. Not true $150.00 5. Refurbishment Charges/Bathroom dirty. Not true $75.00 6. Refurbishment Charges/replace all blinds. $100.00 I'm not sure what to do now. The goal is to have the TL deleted, but I'm not sure if that can be done. I would think there would be some depreciation on the carpet, blinds etc. since I was there for 3 years. Any ideas of what to do next. I live in Ohio and the CA is NCS.

I was hoping to stay away from Orchard Bank, I've had offers from them - 79 AF, 300 credit limit. I've always read that their customer service stinks! I thought Best Buy wasn't the easiest to get credit??? but I didn' think about Jareds or Kays, so maybe I'll try that. Was hoping maybe Macy's might be a good try. I see so many people getting the Hooters Mastercard, so I thought I may try it. I don't want too many inquiries, so I need to pick my places wisely! All suggestions are welcomed!!!! --- but i'm staying away from First Premier, credit one, and orchard if at all possible. I have a cap one in good standing, 500 limit I just got my first baddie removed, thanks to this site! It does work if you are persistent!

Just got my scores up around 615. It's been a battle!!!! I've heard that Crown Jewelers and Hooters MC are good rebuilding TLs. Any thoughts on those or other suggestions?

I've read tons of information on this site and I'm having information overload! I'm read the following information: 1) Try to go the route of sending Validation letters and try to get deletions. 2) Try to go for a pay and delete - athough I've heard that's nearly impossible. 3) The longer an account has no activity the less it impacts your credit score and sometimes it's best not to pay them 4) Paying a collection account does not help your score I don't know which route to take??? I do have good accounts as well. I have a joint car loan with cap 1 for 22k - never late - 3 years history. I have a cap 1 credit card with limit of $500 - never late, 3 years history. I'm an authorized user for a chase and discover cc, it is on my CR - never late, 1 year history. My score is 597 EQ. Where do I start with these baddies? Which route do I take? I'm a newbie. Any expert help would be appreciated.
