Hey guys, awesome board. I've read just about everythread on the Student loan portion of the board but haven't come across this situation yet.

 

I have been battling with Sallie Mae for about a year now about some late pays they show for the last 3 years. The problem is I've been requesting military deferments between deployments, in school deferments, and in between payments made by the Army in the Student Loan Repayment Program. In short, I have always had some brand of deferment on my loans since 2004. Some of them overlap.

 

Now the issue is, everytime one of these new deferments are initialized or a payment is made, they magically start reporting me as being late soon after for periods prior to the payments or new deferments.

 

Some steps I've taken to remedy this are:

1. Calling and speaking to numerous representatives and managers.

2. Multiple emails.

3. Multiple letters.

 

Now it seems like they are at least making an attempt to correct these matters in some form but it always turns out that they just shuffle the late payments away from the dates I mention onto different dates. I have submitted an incredible amount of evidence and they make some changes but they never seem to get it right. I have been hung up on and they always come at me with, we have to report accurately. I understand this is the standard reply and student loan companies have more stringent reporting requirements but you would think since I have a valid claim for correction and evidence, they would just remove the lates.

 

Wrong, they are screwing with my credit and I want it corrected. My final letter will be sent tomorrow outlining the fact that they are to report accurately and the fact that they have multiple investigations with mixed results leads one to believe that is no the case.

 

So if they do not fix the issue, should I elevate it to an ITS or what else can I do? I have already disputed with the CRA's but you know they came back verified.

I can totally relate to your situation with Sallie Mae. They are by far and away the worse company to deal with ever. I would recommend that you document out in a timeline exactly what has occurred. Make one more phone call to a supervisor. Recording the call would be highly recommended, i would advise the supervisor that you are recording the call. There are different laws in different states over recording calls, so I would google and find out the applicable law for your state. Make a final request to the supervisor to assist you fully advise the supervisor that the next step will be to file a complaint with the BBB, FTC and any other regulatory agency that you can locate. I have had such a time with Sallie Mae, I am pretty confident that just by setting up a website and hiring a high powered set of attorneys, Sallie Mae would be an excellent candidate for a Class Action Lawsuit.

I didn't realize their reputation until I started doing some research on them this month. They are like credit nazis.

 

I'm going to send a nutcase letter in a few days and that will be my final attempt to deal with them directly. If they fail to correct after that then I'm gonna start elevating it to the Army legal assistance office to see if a Government attorney has any affect on them.

 

So far I've paid late fees that I shouldn't have, run into interference with my security clearance, and probably have a higher APR on my vehicle loan than I should. Solely because of the 8-9 TL's they are reporting late.

 

Being a semi-government entity is it feasible to take them to court over violations? Am I thinking along the correct lines?

Well, I filed a complaint with the BBB. I'll keep this updated since there are several people with issues from SM. I hope we can all get this resolved. Rest assured, I won't give up. The TL will fall of before I do.
