I had a student loan I defaulted on in 2001 from Sallie Mae.

 

It got transferred to NYS Higher Ed Services. Is this a collection agency?

 

I got on a payment plan with them, and have PIF in Dec 2005.

 

I'd like to try and remove them from my reports and i'm trying to think of the best way of going about it.

 

 

I pulled this report about a week ago and I noticed they still list on Equifax as an open installment account and i opened the account in 1/1/0001. haha.

Account Number: SLMA TRUS--XXXXXXXX

Acct Type: Installment

Acct Status: Open

Monthly Payment: $77.00

Date Open: 1/1/0001

Balance: $0.00

Terms:

Payment Status: At least 120 days or more than four payments past due

Comments: PAID COLLECTION

You might try posting this in the Student Loan forum as well, you might get more attention over there.

 

I believe the NYS system acts as a loan guarantor so they are not necessarily classified as a CA. Sallie Mae provides the money but NYS Higher Ed guarantees Sallie Mae they'll be reimbursed if you default, and are in charge of collecting in that instance. I believe being the guarantor on the loan makes them an OC and not a CA, but it probably varies by state. If you have any original loan paperwork, or you have a Department of Education PIN, you can find out if they were the guarantor on your loan via the NSLDS using the links from the Department of Education's webpage, www.ed.gov.

Interesting.

 

From a thread earlier I learned that collection agencies aren't allowed to have an "open" status or that they can't state that I have late payments as I did not enter into a credit aggreement with them.

 

But, as a guarantor(sp) I wonder if they are both OC. I might just post this in the student loan section tomorrow.

Doesn't really matter is they are OC or CA, they still have to report correctly.

 

This must be EQ trade line, with the 120 days late. They are notorious for this, but persistence pays off.

 

You may not get a removal (or you might, who knows), but guaranty agencies, including NYHESC, are bound by FDCPA as well as FCRA, and have to report correctly.

 

The above TL is in violation and can be corrected. Federal law mandates their TL cannot be inaccurate or incomplete.

 

(I did get them to correct mine, fyi. Persistence is the key.)

I actually sued them for violations of the FCRA and FDCPA. They are not a CA, they guarantee loans. If they are attempting to collect on what you owe, your loan is already in default. They then assign CAs like Pioneer, NCO, etc to collect for them.

Good for you, Getty. I tried a search on AOC archives (google) thinking I might find more on yr case there, but only located a couple of early posts, bef you filed suit. The violations you discussed there are typical.

 

Since I am tired of the SL tactics/violations (and the naysayers), I would like to see yr summons, or anything else you might be willing to share.
