I'll make a long story short. I had an ebay business for a short period. I got setup with a cc processing company called Cardservice International. I only made 4 charges using this merchant account. They were large because I sold bulk electronics. The total of the 4 charges was $16,000. The company never deposited any of this into my bank account. The day after the charges were originally made I got a call from a man named Jason in their fraud department whom said the charges were being investigated and that if I wanted the funds I would have to ship the product first. I never agreed. So the funds were NEVER deposited and I blocked their access to my checking account through my bank and went on with my life.
Now 3 years later they claim I owe them the $16,000 that they never deposited into my account in the first place! I've been battling this for a year now with their collection agency - Allen & Associates. Today they mailed me a list of supposed "deposits" into my account. Although if you ask me it's not too hard for them to print up a piece of paper with my account number on it and a dollar figure next to it. It is not a bank statement or any other certified document that they sent me. So I went to my former bank and obtained records from this time period to prove that the deposit was never made. Allen & Associates told me not to waste my time sending them my bank statements and that they were going to sue me so that I should just go ahead and save these papers for my records and give copies to my attorney.
This false $16,000 debt has hurt my credit score tremendously and the fact that they won't even accept my copy of my bank records to prove the deposits were never made is frustrating. The man on the phone also "claimed" that a representative from my former bank would be present to pledge the deposits were made although I think he has to be lying because they were not made so it's impossible. I've spoken to my bank and confirmed this. I paid for 3 copies of my former statements to prove this as well.
Help I really need some legal advice!
