Thanks Marv!! I'm so excited. When I joined this forum in 2008 I had sub-600 credit scores and a lot of work to do. You guys gave me the resources to correct my situation and now it's finally paying off!

Do they have a permissible purpose to pull a hard like that, even after they clearly couldn't verify the information they tried to report? As far as the SOL, I know they can attempt to collect, but they can't threaten or make it seem like there's litigation pending, when that legal action cannot be taken on the debt, right? I'm just trying to figure out how to get that stupid hard off, and how to get them to stop calling now, its not even about the money... Just stop calling the house and waking up my kids during their afternoon naps They've apparently called two other times!

So... what's the consensus now that they deleted the TL... Just send a Non-PP letter since they pulled the Hard AFTER the results of my investigation deleted the TLs?

Apparently its zombie debt Allegedly its from a Providian credit card. Previously, a company called Pr0line S0luti0ns attempted to collect this debt, but they dropped it after I timely DV'd them about 8 months ago.

In Florida SOL is 4 years for written, 5 years for Open... By either interpretation the SOL for the alleged debt expired in February 2009 based on Date of First Delinquency (02/2004), although Date of Last Payment was 01/2004 and that is what Florida goes by. The timing is key on the Non-PP though... I disputed on August 4th online, the results from my dispute show both tradelines deleted from my credit file dated August 5th, and P@yst@r pulled the HARD on August 6th... Bingo, right? I've already got them on (just listing the good stuff from Florida that affects this): Florida Statute 559.553 Registration of consumer collection agencies required; exemptions.-- (1) After January 1, 1994, no person shall engage in business in this state as a consumer collection agency or continue to do business in this state as a consumer collection agency without first registering in accordance with this part, and thereafter maintaining a valid registration. (2) Each consumer collection agency doing business in this state shall register with the office and renew such registration annually as set forth in s. 559.555. (5) Any out-of-state consumer debt collector as defined in s. 559.55(8) who is not exempt from registration by application of subsection (4) and who fails to register in accordance with this part shall be subject to an enforcement action by the state as specified in s. 559.565 Florida Statute 559.72 Prohibited practices generally.--In collecting consumer debts, no person shall: (9) Claim, attempt, or threaten to enforce a debt when such person knows that the debt is not legitimate or assert the existence of some other legal right when such person knows that the right does not exist; (12) Orally communicate with a debtor in such a manner as to give the false impression or appearance that such person is or is associated with an attorney;

No, can't do that in Florida, and they spoke to my wife =( Anyways, I just got the results from the Online Dispute, and the 2 TLs were DELETED (as they should be!) But I still think I can get them on the Non-PP and the threatened litigation, no?

Long story short (names and sensitive infor masked ): CCT pull on 7/31 showed them pop-up as a collection with Account #A CCT pull on 8/4 showed them pop-up as another collection, so now they are reporting Account #A and Account #B I was writing my DV letter to them, as jack suggested (thank you jack!), but I also initiated a dispute online on August 4th (I know I'm not supposed to, but I wanted to just get that initial "not mine" out of the way). Anyways, guess what happens... I looked today at my CCT and P@ySt@r had pulled a hard! In addition to all that nonsense, my wife receives a phone call today from a "Steven Klein" who says there's pending litigation against me at 2PM and I need to respond to the call with the "case" number her gave her. Of course I check online court records, and there's no litigation (big surprise)! So, the question is... where do I even start! I smell blood So, 1 - They're not licensed in Florida to do debt collection, 2 - The debt is out of SOL in Florida, so they are attempting to collect when they legally cannot (FDCPA violation), 3 - They threatened an action that they cannot legally take (FDCPA and Florida Statute violation), and 4 - Their hard inquiry (which came after my CRA dispute) is non-PP (FDCPA). That's a lot to write in one letter, I was thinking of just keeping it short and combining a Non-PP, Unknown Debt, Non-Licensed into one FOAD letter. Thoughts?

Hey folks! It seems like its been forever, but just when I thought I was in the clear, I pulled my CCT on Friday and noticed I have a new Negative TL from a company called P@yst@r. It reports as opened 7/1/2009, and I have no clue what the hell this maybe. Anyways, I was wondering if you could give me advice on a course of action. Should I send them a DV immediately using my discovery on the CR as my "initial communication" for the 30 day validation window or should I go straight with the CRA dispute and then use a modified version of Jen's 1-2 623 Punch? If I go the DV route, I was also going to point out to them that I looked up their name in the Florida Office of Financial Regulaiton, and they're not licensed to do collection activities in FL.

Damn EQ didn't delete the PR... Looks like its time to write a letter to the court and ask for how they verified the info. Then I'll send EQ the nice letter the court sends back that says "We don't furnish information."

I would keep it simple. Just use the letter from Whychat's page -> http://whychat.5u.com/deletejudg.html Tweak it slightly, but stick to the basics. It's what I did, and TU deleted within 3 days of receipt of the letter. -
They are still off of my TU, but on EX+EQ. The OC is still on all 3 though for me.
