I have a Palisades Collection the I paid about 3 years ago. This is the only collection I am having trouble getting removed.
I have seem many posts around the internet, but nothing seems to work.
This is the lastest:
I paid my debt to them in full and they were rude even when I called to find out what their mailing address was to send the check. Out of the 11 collections that I had (and paid off in full) they are the ONLY ones who refused to remove themselves from my credit report, and they are STILL re-verifying with all 3 CRA's that I paid in settlement rather than paid in full. They have always been rude, completely unprofessional and they have (I hate to say it) the typical New Jersey/New York attitude. Don't expect ANY favors or even civility from them.
oh any yes I have a letter stating that I have Paid in Full, submitted it to all 3 CRA's, they all corrected it to say PIF in April, then in June it was re-verified by Palisades to say "Paid in Settlement" again because they said I DID owe more money in fees that they just "wrote off for me". I have sent the information in AGAIN, as well as to Pattenaude and Felix (the attorney for Palisades) and AT&T who was the original debtor. So fingers crossed that SOMEONE will fix it for good!
I just re-sent in the second round of proof day before yesterday ... do I have to wait for 30 days before I dispute again or can I act today?
I just went ahead and mailed the goodwill letter and documentation to AT&T's payment address. Probably will get round filed but at least I know I mailed it.
Back to Palisades ...
It has been a couple of weeks since I sent the goodwill letter to them, no response to date. I did notice something on my Experian report that I have a question about. Under comments it says "Election of Remedy-reported by subscriber" ... what in the heck does that mean?
and under the 24 month payment history it is blank except for a "KD" in the July 2008 square ... does anyone know what that means?
Okay another chapter in my Palisades Drama.
I just spoke to a very nice, helpful woman at Equifax. I explained about sending in the proof regarding a letter from Pattenaude and Felix on behalf of Palisades Collection LLC. She apologetically explained that they COULD NOT accept the Pay In Full letter from Patenaude & Felix because it was not written by Palisades or on Palisades letterhead. What in the heck do I do now?
She suggested that I dispute the entire debt based on "fraudulent charges" in that the person at Patenaude and Felix that I talked to said that I actually owed "fees" that they just "wrote off" for me, and that was why my debt could not be considered Paid in Full. So now I have ANOTHER dispute, but as this was JUST Equifax that I talked to, I'll also need to dispute with the other 2.
Problem ... if I just say "forget the dispute" and threaten to sue, I don't HAVE the money to sue. And I agree with not threatening if I'm not really going to do it. So what do I do?
here's my update today on this ... Equifax's report confirmation was emailed to me today (6 days after disputing Palisades based on fraudulent charges) and it WAS SUCCESSFULLY REMOVED. So now I need to dispute based on the same thing to the other 2 credit bureaus, and HOPE for the same result!
I'm still waiting for the other CRA's... I have been working on my follow up letter to the "goodwill" letter that I sent to AT&T, Palisades and Pattenaude and Felix in the event that Transunion and Experian don't remove them. None of the creditors/parties involved responded to my goodwill letter, I assume because it is a paid off item that they just don't care, and maybe they legaly don't have to respond? And I am holding out hope that the goodwill letter will actually work and that Palisades won't respond to the disputes. I have 2 more days to wait on the Transunion dispute, and 4 more days to wait on the Experian dispute.
I basically based my complaint on 2 things: first, obviously were the fraudulant charges that Palisades claims that they "wrote off" out of the goodness of their hearts. They sent no documentation to me when I asked Patenaude and Felix for it, nor did they give me the opportunity to pay these supposed fees. I wouldn't have paid the full damn balance if I wanted a "settlement", would I have?
The second part of my letter will address the fact that Patenaude and Felix had no legal right to write the paid in full letter (that was actually incorrect as far as they are concerned NOW) and I guess I will take that up with the Nevada Bar Associaton as well as anyone else that is suggested on here? If they didn't have the authorization to write the letter, why did they? And also the 3 letters that I have were all supposedly written by the same attorney, but all 3 of the signnatures are drastically different and were obviously signed by 3 different people but the same name each time. Can that be addressed as well in my complaint?
My Question is, should I dispute saying Fraudulent Charges, if in fact I just want it removed? Or is there another way to get it removed?
