I'm going through the same thing with CITI but for a smaller debt. I got a letter and thought it was bogus, and called citi directly. It wasn't bogus, but they were nice enough on the phone. I doubt you have anything to lose by calling them...but probably nothing to gain, either.

That doesn't mean you should go apply for more Comenity cards! Resist the urge! Of course not! I don't plan on applying for any cards for a loooong time. The only reason I even ended up with this one was because I'd forgotten my debit card one day and needed the stuff in my cart. Figured I'd give it a shot, didn't expect to be approved though!

Woo! After Lane Bryant charged off my account in 2007, I managed to get another "second chance" card with them this last summer. It was only for $100, but hey, it's something. I paid my bill the other day and they bumped it up to 500! A small victory, but a victory none the less. Funny considering I still technically owe Comenity on two old accounts.

Thanks CG, that's what I was thinking. The slip does say "my account is now settled" or something to that effect. Now I'm just weighing the pros and cons of having something roll off my credit report in a year and off public records in 3 years vs paying it, being done with it, but having it listed on my credit report for another 7 years, even though it's paid. -

Good point, pryan67. Hadn't thought about it that way. So if I just continue to wait it out, what's the worst case scenario assuming I don't have any real estate? Like I mentioned, I'll be returning to school soon so likely won't have income they could garnish even if they wanted to? -

I'm in Oregon, the judgement was issued in California. Both are ten year states, I believe. Whats my worst-case scenario should I just keep ignoring it? Like I mentioned, I don't have a paycheck coming in, I'm going back to school soon, and if they wanted to garnish my bank account they'd have to transfer the case to Oregon first. My husband and I do want to purchase a home in the relatively near future, but due to my credit (and lack of income) we would probably do so under his credit only. As far as I know, I'd still be on the deed, just not the loan? -

They are collecting for Citibank. Citibank still owns the debt. -
Looking through my credit reports recently as in trying to clean things up, and Sallie Mae is listed on my report as defaulted. I saw this a few years back and disputed it, but it's still there. This was a small student loan for a total of about 1750 that was paid as agreed and was never late, let alone a default. I'm pretty sure I don't have any remaining evidence that it was paid off, but I know for a fact it was. It is listed as being paid for by insurance...again, not true. Additionally, when applying for student aid in more recent years, nothing ever came up in the financial aid process that showed a defaulted federal loan. What gives, and how do I go about getting this off my reports?

The judgement is at 1800ish right now, and they're offering me half off. They did disclaim they'd be sending out a 1099c...is this a big deal? I domt report any income right now, but my husband and I do file jointly. Is a $900 debt wrote off really going to screw me over that much? -
Well the initial letter only stated the offer, and then where I check which option I'd like to take, it says "satisfied in full." Getting another letter that says that seems redundant? If I leave it alone, it falls off in a few years. I currently don't have any garnishable wages and though I do have a bank account in my name it is in a different state than the judgement. Not sure how aggressively they'd go after an $1800 settlement but I don't want to tempt fate, either.

Hey all, I posted a topic a few days ago but it's a little jumbled and all over the place so I thought I'd start fresh, since the situation has evolved a bit. Received a settlement offer from a CA for a judgement I had placed against me back in 2008. They're offering me 50 percemt off, but as per your advice (as well as an attorneys) I'm asking CA for something in writing stating the terms of the settlement...specifically that once paid, the judgement will be marked as paid in full, and the remaining balance will be extinguished and uncollectable. CA claims that since they are a third party, they can issue no such letter. OC claims they can't either, and seems really puzzled by what I was asking. I'm not thrilled to hand over 900 bucks if I'm still goin to be dealing with this later, but I also want this to be over with already. Do I refuse to pay without something in writing? I've asked four times total now, with the same response each time. If I send payment along with a letter out,lining what they've told me on the phone (that the account will be considered paid, and that they'll send me a paid letter upon receipt of payment), is that enough to cover me if someone tries to collect more I'm the future, provided I have copies of everything I send to the, in my own records? Even my friend-of-a-friend who works for a collection agency said get something in writing, but it sounds like I'm not gonna get that. What the heck do I do?

I contacted citi directly and verified who was handling the collection, and it is Convergent. I called convergent this morning and told them I was interested in accepting the offer, but that I needed something in writing stating that the judgement would be satisfied. They said they couldn't offer anything due to legal reasons, and because they are a third party. Citi still owns the debt, and convergent is just collecting on their behalf (I confirmed this). I only called because I don't have time to do all of this by mail. This is the first communication I recovered. There was a disclaimer printed on the back about validating within 30 days, as well as a disclaimer regarding a potential 1099c being issued for forgiving a debt. Where do I go from here?
