  1. I find it amazing that if given the chance most of the country (if not all) would vote for BK inclusion of student loans yet this is not the case. There are some petition groups on the subject although I don't know if they are going anywhere with it. my two cents.
  2. Hi All, Had some financial issues lately and am behind 3 months on my auto loan to Wachovia (previously WFS). It has been sent to collection and when I called today to ask the collection person what the payoff was he said asked what I wanted to do about the past due payments. I said I am not sure yet but I need to know the payoff so I can sell the car otherwise I would have to give it back to the bank. He said that they are demanding the car back, where can they come pick it up. I said I don't want to go that route just yet. I need to get the payoff amount. He said again that it doesnt matter and they are demanding the car back. I said put it in writing and send a letter. He said "we don't send letters". He was pretty rude of course and I hung up on him after being frustrated. They don't know where it is garaged now since I moved from AZ to another state. I don't want to hold it but after reading all of the different topics and elsewhere on the internet I am not exactly sure how to proceed. 1. I want to know my payoff to determine if I have another option. Should I simply send a letter to them also requiring to deal direclty with the creditor and to contact me by mail only? 2. I need to use the vehicle a little longer. How long can I hold the vechicle? I heard somewhere that they can declare the vechicle as stolen. Is this true? Any thoughts you have would be greatly appreciated. Thanks, Rpersonal
  3. Well, I have tried to offer a settlement but it was not well received. Too many flunkies working as collection reps. Their supervisors are even less intelligent and I haven't figured out to get to the right person. Although my scores are better I am looking at acquiring a business line of credit approaching $300K. But I need to get rid of these 3 to both boost my score and to avoid any red flags with the underwriting dept.
  4. Hi All, I was hoping someone can help. I have done some good repair over the last 2 years. I added about $55K in new credit and moved my scores from 530 to over 680. I have 3 remaining old things on my credit that are still affecting me: HSBC Auto - two 60-day lates - debt was paid in full over 18 months ago HSBC - charge off - $1500 - debt was paid in full 2 years ago Plains Commerce - charge off - $350 - debt was paid in full 2 years ago The lates and charge-offs are valid and since that time I paid them in full, not settled in full. I have pleny of cash these days and have turned around my financial situation dramatically. I have done many disputs both the the ca and cra's. Reports always come back verfied. Validation letters didn't work for me. I now have an attorney, although with little experience in this area, who is willing to participate in a letter campaign with me and sign his name. I would like to intimidate these companies into deleting these accounts from reporting. Since the debt is paid in full wouldn't it be easier for the CA to just delete these accounts rather then spend more money on debt they already collected on? I am willing to spend thousands if necessary on my end. Does anyone have any idea if this has worked before? Any letter samples from an attorney? I have checked most of the letter samples here but have found none. Any help you could give would be so greatly appreciated. Thanks, rpersonal
  5. Hey all, I could use some advice. I had a past due account with Household bank that was sold to First Financial (some rinky dink collection agency). I agreed to make payments and I made a good faith one time payment by check by phone for $400 (total due was $2200). They made the payment. All of a sudden, I notice in my bank account that they charged the entire remaining balance of $1800 to my bank account WITHOUT my authorization (of which my account went negative). They basicaly committed fraud as I never authorized them to write the check. I am obviously really pissed off about this. Any advice as to recourse direction? Thanks, Rob
  6. I misspoke, I didn't send a "validation letter". I sent and dispute letter with a request that they provide documentation that my rights have not been abrogated...blah blah blah.

  8. Hey All, I have been putting in a few disputes with the CRAs for the last 4 months. And have improved my score dramatically. I even got a friend to add me as a joint user on 2 of his cards that he uses sometimes but never maintains a balance with. This gave me over 5 years of instant credit history which jumped my scores. Here is the issue. I have done my disputes (using a request for validation letter which just led to a regular investigation) and TU & EQ have both deleted most of the requested items. But somehow EX seems to be saying that the debts have been verified? Somehow I find it hard to believe that all of the disputed OC's would only respond to EX and not the rest of the CRA's. The only thing I can think of is to keep disputing, but soon I am sure they will throw me in the frivolous pile. Any thoughts or suggestions? rpersonal P.S. The good news I just got approved for AMEX Blue Cash - they pulled EQ.
