Centex, I am not sure what sandbox rules means... She went to court, and signed something. I assume it means there is a judgment as she didn't put up a fight. -

About a year. She was sued, and has to pay these people. I don't know if they are a JDB. -

So my girlfriend and I are leaning towards paying this CA, based on these two letters, I mentioned above in this thread. If anyone thinks this is a huge mistake, we would really appreciate knowing before we do this !!! Thanks, Plex -

Yes sit seems that the FDCPA is saying that if it says something in words a "least sophisticated consumer" would interpret as full and final, and satisfied, then that is what it means. -

anyone else think this is good, or should my GF really push for "debt cannot be sold or transferred". She asked about it, and they said there were only certain things Massachusetts law would allow them to put in writing (or something to that effect). It sounded like BS to me, but what do I know? -

I added emphasis to the letters above. It states "satisfied in full" and "full and final settlement". -

Thanks for the help... The full wording is much longer: "Dear Plex's Girlfriend, Please be advised that our client has agreed to accept the sum of $5,120in full settlement of the above account provided said account is received by our office on or before April 18, 2010. Upon receipt of the settlement amount we will endorse the Execution as satisfied in full and return it to the issuing Court. Be aware that in the event the full amount of the settlement is not received in a timely fashion, the settlement shall be deemed null and void and any funds received will be applied against the full balance due on the account." and then a different letter recenetly: "Dear Plex's GF: This is to acknowledge receipt of your payment in the amount of $75.00. Your payment, dated March 18, 20010 was received and applied to your account balance on March 19, 2010. Please be advised that the current balance on your account after crediting you with this paymeny, is $7800.45" Our records indicate that on March 18, 2010 we agreed to accept the sum of $5120.00 in full and final settlement of your account provided said amount is paid by April 18, 2010. After applying your recent payment against the settlement amount, please be advised that the additional sum of $5045.00 must be received on or before April 18, 2010 or the settlement will be declared null and void. To take advantage of the settlement, the settlement amount must be received by April 18, 2010" My emphasis added. -

"Our records indicate that on March 18, 2010 we agreed to accept the sum of $X,XXX in full and final settlement of your account provided said amount is paid by April 18, 2010" This is the phrasing used, sent from the CA/attorneys who sued my girlfriend. But you are saying it doesn't actually mean the account is truly fully and finally settled? This stuff is confusing :\ -
Can you attempt a DV, when you have already signed a court order?

I figured, but she didn't know that DV's existed when she went to court. Are there any other ways to get it off her credit report? Or should we just be trying to get a reduced pay-back amount? We appreciate the help. -
