I mailed off a few on some that are simply stuck and won't go away. How much time do you typically give them to respond? The letter says postmarked 15 days, are we talking business days or straight days on the calendar. Then give a few days for the letter to be make it back to me. I guess on the first round it's time to start some validation..again. *sigh* Edit: that should read PFD. Sorry.

Lynn, While I do appreciate your help, you seem rather hostile towards people when it comes to Student Loans. This is something I had never encountered when I was doing credit repair for myself and DH a few years ago on different parts of the board. I'm trying to learn, to figure out what happened and WHY. As in, I am trying to learn the process. Once I understand what has happened, I'll be better able to handle what happens next. I am NOT going to simply accept a phone call from a stranger and hand over personal information. I don't care if they say that they are from the government, I'm not going to randomly hand over banking info, etc. Look, the point is, I'm trying to learn and you're taking an attitude. Regardless of what my DH did or did not do in the past, he's owning up to it now and is trying to do the right thing. This is what it says for the Stafford Loan under Servicer/Lender/Guaranty Agency Information This loan has been transferred to the Debt Collection Service of the Department of Education. For answers to questions concerning this aid please contact the service at Under the Perkins Loan it says: *I'm not going to put what it says, but it listed the college attended. Does this mean that the Perkins is not currently with CBE, therefore has not been subrogated? And the Stafford Loan has been subrogated? The phone number listed on the website does not appear anywhere on the letter from CBE. So no, I would say that CBE has not gvalidated their claim just because an outstanding Loan is listed on the nslds website. You said Perkins had been subrogated, and according the the nslds website it's still with the college DH attended. So has it been or hasn't it? This is why I would like CBE to validate, because I have no idea WHICH loan they are trying to collect on!! But you keep saying it's a stall tactic, and I keep telling you that I am NOT using it as a stall tactic. This is all new to me with Student Loans and confusing.
-
Thanks again for the info Lynn. I have been reading and I'm still confused about a few words. What does subrogated mean? (We really need a sticky of glossary terms in this forum. lol) And how do I find out if that happened? Again, I am not trying to stall, just trying to figure this all out. BTW, this is for one non subsidized Stafford loan and one Perkins loan.

Additional information as of today. Received letter from them and now the total is $49,600.72. They include the standard "dispute the validity 30 days, etc." line. I will look, but is there a specific DV letter to use when dealing with student loans? Is it different from the ones used for credit cards or auto loans? Also, went to the nslds site and got the pin. Total amount including interest according to them is "only" $33,149. Can anyone explain where the additional $16K comes from?

Hi Lynn, Thanks for the information. We are trying to react to this but we want to confirm all the information before we start to randomly hand over money. We aren't denying that he owes, but I don't think that asking for information in writing is a stall tactic. We want everything written out. Original amount, interest rate, etc. Seeing as there has been NOTHING in years about this, I don't think asking for validation is a bad thing? Do you know how DH would find the PIN # that is asked for on the link you gave?

Okay, some additional info. He got phone call from them saying that they are reviewing this and will start wage garnishment but it has not been processed as of yet. They want to work out a payment plan so that doesn't happen. DH told them to again send him something in writing. They claimed to have no record of the phone conversation from April where he requested everything to be sent to him via mail.
-
This is for DH. He got a letter or something today notifying him that CBE is garnishing his wages for this. They got in touch with him in April of this year regarding this student loan and he told them to send him a letter with all the info. Well, we never got the info, instead he got this. I have NO idea where to start or what to do. A few years ago I fixed my and his credit and there was nothing on his about this loan. If there had been, we would have addressed it then. So this is coming out of the blue. I would estimate that this loan is over 15 years old. To be honest, he doesn't even know who the original loan was through. Does CBE have to provide any info, like with CC companies or auto loans? How do we stop the garnishment? Can it be stopped?

Hello all, I've not been around much as I've been having a bit of a crazy time in my life, but now I'm back. Anyway, down and dirty. My car was repod earlier this month..the 13th. I think they did it illegaly but I am not sure. I read up on CT repo law and it looks like the bank doesn't have to notify me of intent to reposess? It says something like, "the retailer may choose to notify" I received no phone calls from them as for some reason they were calling a phone number from an address the states ago. Nor did I receive any certified mail/UPS/etc from them regarding this. I KNOW for a fact that they had my current phone number as they have called me at it before. In fact, the phone number they were calling was one the ORIGINAL loan holder had before the loan was sold to the current bank. So, when I went to fill out all the new paperwork, I gave my current address and phone number on all of the paperwork. And that was about 2 years ago! I guess my main question is, can someone point me in the right direction to read up on CT repo law and determine if, in fact, the bank had to notify me of intent to reposess? OO sorry, one mroe question, the bank is not in CT, but in Massachusetts. Which laws take preceidence? Once I know that, I'll be able to proceed with more questions and details. Thanks.

Well, he just retired this year and is getting a nice pension. He probably hasn't invested in the stock market, so it's probably in low yield "safe" bonds and CDs. Though to be honest, it wouldn't surprise me if it's all in a savings account.

I have an uncle who is the same way. When he wanted to buy a new car about 15 years ago, instead of getting a loan for it (I don't know his logic, but am assuming he didn't WANT to get a loan, not that he was declined for one.) He chose to get a second job at a Bradlees, working weekends until he had saved enough to pay for the car in cash. Keep in mind, he had a good paying job and has lived with my Grandmother his ENTIRE life. He's never had a CC and his expenses are minimal.

Yes, thanks for the info. I'm still going to hold off on even spending the $16.00 for now. I'll wait until I see Discover pop on MCK. As it could be more than a month before it pops, in which case I would have wasted the free trial portion of your advice.

So, I was added as an AU to a lovely Discover card. This was, oh, three or four months ago. Finally figured out the reason it wasn't reporting was use the card is never used. So I charged something on it earlier this month. I figured (from all I'd read on here) that it would report either yesterday or today because there was finally activity on the card. NOPE! Nada. Nothing. Well, at least per MCK and I'm not willing the shell out the money for FICO yet. So now I have to wait another month and hope it pops at the end of June.

swallman, Excellent advice. Thank you!

http://creditboards.com/forums/index.php?s...36entry746036 Background thread. As of this morning that silly CA is gone from all three reports, per MCK. woot! WOOT! BUT I don't want to (but really I do..lol) pull myfico today because I finally figured out why Discover wasn't reporting me as an AU on my Father's card. He never uses it! So a couple weeks ago I went to Wal-mart and bought some Mother's Day cards and used the Discover card. (with Dad's permission of course to accually use the card.) So now I'm waiting for the cycle to close and for it to report. I hope to get a nice score boost when it finally reports. So, tell me not to pull! Help me not to pull! Will someone please come to my hosue and take me offline until it reports please? My fingers are itching to go into my wallet and shell out the money today! hehe Also, this leaves me with one OC baddie (which I am ready to read the mother OC thread this week and see how to attack that one) and NO MORE CA TLS! Yeah! THANK YOU CB! Without your help I would have been lost and confused forever.
