The Master Equifax & TransUnion B* Bumpage Thread
vgirl17 replied to BobWang's topic in Credit Forum
Not sure if this is already common knowledge or if this will end up re-appearing on my TU report but at first I was able to b* my stickies off, then a day or so later they would be re-added, then I'd b* them again, but each time fewer would get re-added. Now I've been sitting at 0 Inqs. on TU since the 10th. (from MPM reports) -

Yes, a balance on a closed account REALLY hurts your utilization because you have a $0 available limit with a closed account so if you owe ANYTHING on the account the utilization will be computed by the system as a negative number. ie. $3,968 out of $0 available = negative utilization percentage. I also am also having to deal with this on a closed account that I am still paying down. Also, you can call the company that is listing you as an authorized user and have them remove you as an authorized user. They should be able to do it for you without any problems. Good luck! You're on the right track by taking care of this now.

FYI - I went to the BBB and finally got them to remove a TL that they failed to validate properly. Sorry this is so long but I'm hoping it will help in some way since we were ultimately successful. Their first response to the BBB complaint we filed was as follows: Dear Sir or Madam: Asset Acceptance is in receipt of correspondence from your office, dated May 24, 2012, concerning a complaint filed by (consumer). I have had a chance to review the consumer’s complaint as well as the account history. The account is question is for a (OC Name) account that was opened in October of 2005. The account was sold to AALLC in September of 2007 by (first CA name), with Mr. Money (social security number xxx xx ****) listed as the responsible party. Please note the Mr. Money paid this account in October of 2010. (see enclosed payement) AALLC has investigated the information it is providing to the consumer reporting agencies regarding the above referenced account. Based on our records and what we know to have furnished to the credit reporting bureaus, we have concluded that we are furnishing accurate information. Because we do not have the information (e.g., credit report) Mr. Money is relying on, our investigation is somewhat limited. If your office or Mr. Money would like to send us that information, we will review that as part of our investigation to confirm our findings. I trust that this has adequately addressed the complaint. However, if I can be of further assistance, please contact me. This was our response to that: Better Business Bureau: I have reviewed the offer made by the business in reference to complaint ID ######, and have determined that this proposed action would not resolve my complaint. For your reference, details of why I am rejecting this offer appear below: Asset Acceptance states in their response that the account in question was sold to their company in Sept. of 2007 by (first CA name) and that the Original Creditor of the account in question is (Name of OC). They also state in their response that the account in question was opened by the Original Creditor in October of 2005, yet on two of my credit reports (which I provided and attached to the original BBB complaint) Asset Acceptance lists this account with the Date Opened: as "10/2007" which they also VERIFIED as accurate to the credit bureaus when I filed a dispute with them. This by their own admission is not accurate as the account in question was opened 10/2005. As data furnishers they are required to report accurate data for the original account they are attempting to collect on however they are not doing so. I never opened an account with Asset Acceptance therefore the "Date Opened" should reflect the date that the original account in question was opened with the ORIGINAL CREDITOR and not the approximate date that Asset Acceptance purchased the debt. Also, Asset Acceptance reported and verified that this account was placed for collection as of Sept. 2010 AND Dec. 2007, however this could not possibly be the date this account was placed for collection as they both occurred AFTER the account was purchased by them, the collection agency. The only date that should be reflected as sent to collections is the date that the Original Creditor placed this account for collection. Their negligence has caused this account to appear as a more recent delinquency than it really is. Asset Acceptance states in their letter that they do not have copies of the information (e.g. credit report) that I am relying on that pertains to this complaint, however I attached copies of the Asset Acceptance account detail from both the Equifax and Experian credit reports when I filed the original complaint with the BBB. It shows all of the inaccurate and conflicting data provided by Asset Acceptance on both reports. Proof of my liability is my legal right under the Fair Debt Collection Practices Act. I would like to request validation for this debt as previously requested. I am asking that they provide me the following information to validate this debt: 1. Copies of the original contract signed by me showing that I am responsible for this debt, 2. Copies from the original creditor showing how much was incurred on this account, 3. A copy of the contract between Asset Acceptance and the original creditor giving them permission to collect on this debt on their behalf. If Asset Acceptance cannot provide me with proof of my liability I ask that they delete their tradeline from my credit report. As per the FCRA, if no proof of debt exists, it may not be reported to the credit reporting bureaus. Regards, Mr. Money Their second response to the BBB was as follows: Dear Sir or Madam: Asset Acceptance, LLC is in receipt of the consumer's additional correspondence concerning the referenced matter, and has reviewed the same. It appears the Mr. Money feels that we are reporting false and misleading information to the credit bureaus as well as re-aging the account. First of all I would like to reassure both you and Mr. Money that we are not reporting false and misleading information to the consumer reporting agencies (CRA's) as it is the policy of Asset to furnish information to the CRA's pursuant to the Metro II guidelines. Furthermore, with regard to the allegation that Asset is re-aging his account, please inform Mr. Money that this account was purchased on or about September 27, 2007 which is being reported as the open date of this account with Asset. As you know, pursuant to the Fair Credit Reporting Act (FCRA), information may be furnished on an account for up to seven years after an account has become delinquent. The date that has been furnished to Asset as the delinquency date is November 15, 2005. This means that we may report up to seven (7) years from the delinquency date and not seven (7) years from when the account was deemed open with Asset. Therefore, as you can see Asset is not re-aging this debt. Furthermore, AALLC sent its first notice under the Fair Debt Collection Practices Act (FDCPA), Section 809(a), to Mr. Money, informing him that he had thirty (30) days from receipt of our letter to request verification of the debt. He did not exercise that right and thus his validation rights had expired. However, in the interest of resolving AALLC will agree to remove its tradeline with the consumer reporting agencies regarding this matter. If I can be of further assistance, please contact me. Hope this helps. They probably won't agree the first time around to correct/remove the tradeline. Keep at it!

I could be wrong but I don't think you want to pay it if you're going to try to dispute it as "not mine". In my experience a PAID collection is one of the hardest TLs to remove. By paying it you are basically agreeing that the debt is yours therefore hurting your chances to have it removed with a "not mine" dispute. I just went through this with Asset Acceptance. I had to go through the BBB to finally get it removed. In the dispute I said we were forced to pay the debt by the loan underwriter (for mortgage loan approval) even though they still had not verified the debt to us. They tried to use the fact that is was PAID against us in the BBB claim so I know it didn't help.

+1. They should be the ones to help you out. I did this for one of my husband's accounts with Chase. He called them directly and they removed him as an authorized user and notified the CRA's with no issues. The CRAs don't care and probably won't do it. That was the first thing I did. I've called PNC several times over the course of about 6 months and they say everything on their end is reporting fine. They gave me a letter awhile back stating that I am no longer an AU, I misplaced it and now they can't give me another letter because it was auto generated when they initially removed me. They say they can't regenerate it. Has anyone ever had to go further in removing an AU account? I've never had so much trouble with an AU account. What is the date that EQ last shows they reported an update for this TL? Sometimes it takes a while for certain pullers to report changes made to your CR. If it is recent (after you had them remove you as an AU) then I would call them with a copy of your report in hand (to fax if necessary proving it is still being reported by them) and DEMAND that they properly update the TL with EQ. If the first person can't help you then ask to speak to a Supervisor. Where are you getting your EQ report info from? I'm getting it from USAA Credit Check and MYFICO. I didn't think about that. I just checked and USAA CC doesn't show that info. MYFICO shows date of last activity but I don't have a recent report. I have a backdoor report filed away in my home PC but I can't access it (waiting on new power supply). I guess I'll have to check that in a couple of days. Thanks. I just logged into Equifax and my last backdoor report. The last date reported for the PNC account is 02/2012, the account is closed. So it looks as if PNC is not at fault right? What was the date of your latest backdoor report? It's a static report so if they corrected it or updated the TL after the date that you pulled it you won't know if it's been corrected or not until you get a new report. With USAA you can tell the last month a given TL was updated by the last month/year that shows updated in the 24 Month Payment/History table. (See below) In this case the most recent update for all three CRA is July 2012 because there is an "OK" under that month for all three. Do you know how long ago the other two CRA's took to update it? I found that EQ really lagged on updating info compared to EX and TU when my husband removed his AU acct. also. You might be OK.

I COMPLETELY agree. It sounds to me like ARG, LLC may have been the first collection agency that the Sony Fin. Group assigned the debt to originally and when the SOL past they sold the debt (now a junk debt probably) to Smith & Cohen. Don't assume that Smith & Cohen are a legal group or Attorneys of any sort. Their website merley says they provide "highly effective and professional third-party debt collection services". They do not state ANYWHERE on their website that they offer LEGAL services of any kind, claim that they are attorneys at law or that they are members of the Bar Association. This same thing happened to my husband for an old junk debt that was past the SOL. It just appears on his credit report one day out of the blue and we just sent a letter to the collection agency (aka junk debt buyer) stating that they were attempting to collect on a debt that he ALLEGEDLY owed and was already past the SOL and demanded that they remove the TL from his CR. The TL was removed within two weeks of me sending the letter without any response. I also think it's a little odd that the date "Reported" for the account on your credit report occured before the account was supposedly opened. CA are good at mixing up dates to make it appear that they are the dates provided by the original creditor but they are usually not. I would bet that this debt is past SOL. sony balance - N/A Status: Transferred, Closed. Date Opened: 04/06 Reported: 03/06 Date of Status: 08/08 Last Reported: 08/08 Credit Limit: N/A High Balance: $2813 Creditor's Statement: Purchased by another lender Send the letter that was suggested and I'm sure you'll be done with them after that. Good luck!
