  1. Enhanced Acquisition isn't bonded in Texas. At your request, the Secretary of State will issue a Certificate of No Bond, which you can then use to report them to the Texas AG, the FTC, the CFPB, etc.

Disputed as obsolete. DELETED Capital One / HSBC - Joint Card Charge-Off, Scheduled to Age Off in January 2015. Disputed as obsolete. DELETED That's 2 deletions in less than 48 hours! I'll take it. Stepping Stone Goals to Achieve by Oct. 31, 2014: Pay all existing credit cards down to <50% of credit line Dispute 3 charge-offs (2 First Premier cards and 1 HSBC card) as obsolete Pay off 1 medical collection and initiate HIPAA dispute Follow up on prior dispute of 2 student loan lates from March/April 2014 (loans were in deferment prior to lates being reported).   5. My finances took a nose dive during my divorce back in 2008, and for a long time, I was happy to have my head in the sand. But then reality set in. I wanted to be able to buy a new car, own a home, and gain access to credit. So over the last 2 years, I've made sporadic attempts at rebuilding my credit. In that time, I've managed to achieve 7 deletions, have seen a 50-80 point increase in my scores, have refinanced my car at 12% (down from 17.5%), and have obtained 1 AU credit card account, 1 secured credit card account, 3 department store cards, and 1 unsecured Visa. Now that I've regained my footing, I'm ready to dive in to serious repair and restoration mode. I've stashed $3000 away for emergency savings, and I'm in a position to earn an additional $3000/mo in freelance income to supplement my regular salary. This is just my little personal credit restoration journal.   6. @moni08: I've contacted the cell company on numerous occasions. They're unable to locate an account for me using my SSN, my name and DOB, or any of the addresses I've had over the last 5 years. They consistently tell me that if I can't provide them with an account number, they can't help me - even though I've explained repeatedly that I have never had an account with them and am certain it's a mixup. I've also given them the account number reported by Midland, and I'm told that Midland BUYS their debts, so if it's with Midland, it's out of their hands. @ICANHASMUNY?: Don't they have to at least supply a statement or some itemization of costs to identify the debt if I request validation under FDPCA and FCRA? I completely agree with your assessment of same/similar name v. identify theft, and want to tread lightly as I don't have any proof that my ID has been compromised; I have had repeated problems with a merged file related to another woman with the same name, who happened to live in the same apartment complex as me a few years ago. Judgments, hospital liens, collections, charge-offs, you name it. (I have enough of my own credit snafus to deal with; I don't need hers, too!) I've been successful at presenting myself in person to the courts and hospitals with an ID and SS card to prove I'm not the same person, but some of the other issues have been tougher to deal with. This particular cell phone debt has been through Asset Acceptance (deleted after TXDV), EOS CCA (deleted after TXDV), AFNI (deleted after TXDV) and now Midland. Midland is the first one who hasn't deleted after my initial TXDV. I'll try the FACTA request but suspect I'll run into the same issues with the "we can't identify your account so we can't help you" routine. I think a dispute to the CRAs plus a series of complaints to the AG, the BBB, etc. are in order. If the CRAs don't delete, I can go the method of verification route.
  7. I recently sent a Comprehensive Texas DV to Midland Funding / Midland Credit Management for a debt they are claiming is owed to a cell phone company that I've never had a contract with. In the DV, I stated that I disputed the debt in its entirety, and requested validation of the account with proof that I have some contractual obligation to pay Midland Funding the reported amount via: 1. A contract bearing my signature that shows my obligation to pay debts on the alleged account; 2. Itemized billing statements from the inception of this alleged account through the account closing date; and 3. Proof that you are entitled to collect the alleged debt on the original creditor's behalf. I also stated that no federal questions were being raised, and that my dispute was under TFC 392. I received a response today, within the 30 days alloted under TFC 392. It consisted of a one-page letter stating, "Please be advised that we have determined that our credit file and credit reporting o fthe above-referenced account is accurate..." blah blah blah, and stating they would be resuming collection activities. Sometime within the last few days, they have updated the tradeline so that the Balance section is blank. Midland did NOT include any documentation regarding the account aside from their letter. I don't see where TFC requires the CA to provide validating documents, only that they are required to respond and admit/deny the accuracy within 30 days. Should I now send a validation request under FDCPA/FCRA, or is there a clause that encourages me to proceed under TFC 392? I'm 100% certain that they don't have the required documents because I never signed up for service with the original creditor.

CA: 1) ACS State & Local Solutions, Houston, TX Original Creditor: City of Houston EMS Bills of $462, $643, and $542 on Experian only Disputed already as same/similar name and they all came back verified; CA is NOT BONDED in Texas Date placed on report 11/2009 TERMS: 1 month Have you contacted the SOS to confirm no bond exists? If not... do that next. Then get a Certificate showing no bond ($15) in person or by mail. Then send a Texas DV with a copy of that letter to the CA. Include a copy of that Certificate and remind them that if they have no bond, they can't collect and must delete the tradeline IMMEDIATELY. When you get the green card back, file a dispute with Experian (in a letter, just saying the account is invalid. Forward a copy of your letter to the Texas AG, the Texas SOS, the FTC, the BBB and the CA's insurer. If the CA doesn't delete within 30 days (+3 for mailing) count up each and every violation within each tradeline, a violation for each of the verifications with Experian, and a violation for even reporting it (continued collection activity) after receiving your letter. On the 34th day, sue them in Small Claims or JP Court. Forward a copy to their Insurer. CA: 2) ALPAT Company, Slidell, LA; Original Creditor: Capital One Bank $163 listed on Experian, Exquifax and TU. Got dunning letter from NCO in January 2008 (this is a 2007 debt) that said Principal $79.28 and other fees $83.50 total $162.78 Both EX, TU and EU list amount as $163 with dates opened of 6/2011 and dates to continue EX and EQ until April 2014; EQ reported DOFD 7/2007 Disputed 2/2011, came back verified ***TU reporting as Open Account Have you sent a Texas DV here? If not, do that first. Come back and let us know what happens. CA: 3) CenterPoint Energy Houston, Texas Original Credit......Charge $185.....called them yesterday to ask for account into. Account is listed as a charge off on TU an EQ. Disputed again and again.. and they came back verified!!! This account is from 2007; rep on phone said it was from charges of FEb, April and May, BUT she could only send me screen shots of bills via mail......I am pretty sure I did not have three months gas bill of $185.....not here in Texas. AND come to think of it, when I FIRST had this on my credit report, rep told me $100 was from an old address in 1989.......YEP, you read it right......1999. Anxiously to see what they send me in the mail....any day now. I know I'm starting to sound like a broken record, but... Texas DV? CA 4) CAPICO Partners Sherman, Texas.....Original Creditor: Southwest Memorial Hermann Hospital, Houston, Texas (took my then-minor aged son to ER back in June 2006) Was Formerly with FMA Alliance who in turn I susptect sold it to Capio Partners......listed on Experian only, due to fall off March 2013; disputed in September 2011.........yep, came back verified I think you know what I'm going to say here... CA 5) Certified Recovery.....Houston, Texas.. UGHHHHHHHHHHH..........requested validation, they sent back a signed lease which bears my SS# and DOB..darn it. Maybe ask Original creditor (apartment complex to recall debt and ask for a PFD?) CA is bonded in Texas..... ***TU reporting as Open Account Don't be so quick to give up on this one. Did they validate within 30 days as required by Texas law? They sent back a lease, but what about the accounting of how they arrived at the amount they claim is owed? Did they specifically admit or deny the inaccuracy you claimed in your Texas DV, or tell you they need more time? Did they update your report or do anything that would constitute continued collection activity prior to validating? I just got rid of a $5000 apartment charge held by a notoriously difficult CA specializing in that type of debt, even after they validated with a signed lease... because they dinged my credit report with hard inquiries before they responded to my Texas DV, because they failed to account for the deposit I paid to the complex when they listed what I owed upon move-out, and because they were reporting inaccurate items within the tradelines (Open Account, Terms 1 Month, etc.). I sent one followup litigious nutcase letter, demanding $1000 for each of those violations, and they didn't respond. But then the tradelines simply vanished. Texas also has specific laws about landlords and balances. Did the apartment complex ever send you any notices? Look into Texas law a bit here and see where the OC might have failed to hold up their end of the law. Be nitpicky about things. This is YOUR credit report and you have the right to demand its entirely accurate. 6) CA) Resident Data/National Credit Audit Corp, Dallas Texas.....keep disputing and it keeps verifying, old debt from 2007 CA is NOT bonded in Texas...currently taking care of this debt with the help of CPREMS and Ashlia.........thanks, guys!!!!! I assume Cprems and Ashlia are doing a great job of helping you on this, since they've been so helpful to me! But for my opinion, refer to my first response in this post. I'm dealing with a very sticky law firm CA that is not bonded in Texas, uses non-attorney "collectors" exclusively to collect debts (even says so in their signature line) and have conducted continued collection activity at least 14 separate times (4 balance updates per CRA, plus two additional letters that state "This is an attempt to collect a debt" signed by my non-attorney collector. I've spoken with the Texas AG and the California Bar, and even though I'm about to rain hell down upon this law firm, and keep notifying them of that in writing, they just updated my balances again 3 days ago. So, I'm thinking if a CA/firm is brazen enough to try to collect in Texas without a bond, a lawsuit may be your best option. (As a side note, I recall Resident Data being used as a credit reporting agency for an apartment I moved into a few years ago. How can they be both a CRA and a CA? Something worth looking at. 7) CA) Enhanced Recovery.......Original Creditor COMCAST CABLE from 2007......waiting on results from dispute from Experian Did you send a Texas DV to Enhanced Recovery? I just filed suit against them for not responding to my Texas DV, and updated twice thereafter. I sent copies of my correspondence to Ginny Walker(?) in Compliance but got no response. They kind of just do whatever they want and hope they don't have to pay any consequences. 8) CA) US DEPT OF ED.......for some reason it is now not reporting on EX, (probably why FAKO score went up) but TransUnion has it listed as In Collection, Installment Account TERMS $3980 for 36 Months!!!!!!! WRONG WRONG, WRONG....... EQ has it listed at TERMS 36 months SINGLE PAY LOAN (??????) Status: Charge off< Dispute via Jack Attack with each inaccurate item on TU and EQ. When I disputed a couple of latex from US Dept of Ed with a Jack Attack, EQ just removed all the tradelines. EX and TU updated to correct the inaccurate portions of the tradeline. Student loans are the most difficult in my experience.
  9. Possibly. There is a chance that they mailed the response to your DV either before, on the same day, or immediately after inserting the tradeline. Give it another 5 days to see if you receive anything in the mail from them.

  11. Perhaps working in a support position as a legal secretary or paralegal for a consumer attorney? Or maybe finding a way to work yourself into the mortgage business where you help people achieve rapid rescoring and the like? I personally would love to play with credit repair and rebuilding for a living, but "credit repair" as a business is so full of bad seeds. It's so much more fun to help people help themselves!

    You'll need to order hard copies of your reports. You can do that at annualcreditreport.com, or by buying your report from each of the CRAs actual websites and viewing it online or having it mailed to you.
  13. With only 6 INQs left to go on both EQ and TU, and C* looming on the horizon anyways, I did the opposite of what you're supposed to do during B* and submitted 2 new apps. The first, at NFCU, was to open a business checking account, and they pulled personal EQ for the debit card. The second was for CareCredit to cover the balance not covered by insurance for an unexpected surgical procedure. Got 2 GEMB CareCredit pulls, one for the initial application and another for the CIL 4 days later (today). After all was said and done, I ended up with 8 INQs on EQ and 6 on TU. I fully expected to see C* sometime over the weekend (I'm in Texas). But, today when I pulled all of my reports (after apping), I still managed to see some B*. I'm back down to 6 on EQ, and only have 4 on TU. Since I continued to see B* and none of my softs have disappeared yet, should I assume I achieved S*? Also... I have two sticky INQs from June 2011 and October 2011 - both look like mortgage INQs but were actually run by the leasing managers for rental property. Is there any way to remove these things? I'll report back tomorrow re: possible C* in Texas.
