At what point did you provide written notification that they were calling a cell phone? Does the cell number appear on your credit report? Was it associated with the account that is in default? YES, all three questions are relevant...

keep them documented, they must call only between certain hours and can not repeatedly call you. also record those voicemail messages. did they state that they are "attempting to collect a debt"?

 

you can send them a DV + C&D and then if they call they are violating.

 

shut them down now!

MRS had a cell phone that had no monthly fee...BUT YOU PAID $0.25 PER CALL (in or out)

 

(It was a gift)

 

Even if you don't PAY PER CALL...you could say you do...ESPECIALLY SINCE THEY COULD ACTUALLY TAKE YOU OVER YOUR ALLOWED MINUTES

Im not going to pick up the phone or call back.

 

I just blocked their phone number so they can keep calling me day and night hahah. The phone call goes stright to to the voice mail.

I wish my call blocking worked 100% of the time

 

I pay extra for it

 

I was told it is because the CA's call from some system that can't be blocked with my SELECTIVE CALL BLOCKING

 

They told me by E-MAIL I can call on the phone and tell them the specific numbers I can't block for the CA's and they could do some research

 

They are down to only one EVERY SINGLE SUNDAY

 

Since I actually picked up the phone at the right time and started yelling at the lady about being a WRONG number...PORTFOLIO RECOVERY IS GONE (somebody else took up their job)

 

For some reason YELLING at computer calls won't work

The CA may be violating law if the calls are auto-dialer.

 

DV them /limited cease & desist "calls are inconvenient" and to contact by mail only. Make it a very simple letter.

 

Once they are on notice if they continue to call the cellphone they could begin to rack up violations per cell phone call.

 

Two or three cases locally where the debtors walked away with awards of $10k, $15k, for violations of the TCPA alone, that did not include FDCPA plus state laws as well.

Just because you don't know what they are calling about or why isn't going to save you if the debt is potentially legitimate. if it is not...and you are sure that you don't owe anyone, why not unblock, call and tell them you aren't the person they are looking for? Blocking the number and refusing to speak with them may come back to bite you. They simply move forward to putting something on your credit (if they haven't already) or getting a judgement against you.

 

I would do the following:

 

1. Call them back and ask who they are looking for. If it is you, indicate that they must send you something in writing concerning any account and ask them to stop calling your cell phone. Follow up with a LIMITED C&D letter.

 

2. If they are NOT lookign for you, tell them they have called a cell that does not belong to "x" individual. Ask them to remove your number from that account.

 

 

If & when you call.....NEVER EVER EVER admit to any debt...even if you think it MIGHT belong to you. Just ask them to send you something by mail and stop calling you. Follow up with Limited C&D.

 

 

IGNORING THEM WON'T MAKE THEM GO AWAY.

What XLarge Debt said is SO TRUE. My lawyer is working on a case for someone who has FORTY messages from auto dialers on their cell phone. FORTY. TCPA is $500 per call he said. $20k....Even if they settled for $10k! lol. Uh, I'd unblock the phone number.

 

Chances are they won't send you a letter, but will say they did when asked to produce one, it will magically appear. *cough cough* West Asset** cough cough**
