If I inturpeted this right this applies to CA who use false caller ID information when calling to collect a debt.

 

Some read it and make sure I read this right.

 

Your interpretation is correct. Has the Governor signed off on it yet?

You would need a way to print out your CallerID records if you ever hope to exercise the provisions in this statute change.

 

i.e. if you have Vonage, the reported CallerID will show up immediately on the website, plus it will match the Date/Time of your answering machine messages if you record them.

It does make it illegal for a CA to spoof caller ID. Numerous other states have enacted similar legislation and a few of them have taken action against CAs for CID spoofing.

MY OPINION ON CALLER ID (CA's or anybody else) THE CORRECT CALLER ID NUMBER SHOULD SHOW (or my phone should not ring)

 

100% ACCURATE~100% OF THE TIME

 

I pay for the phone service

 

I pay for the CALLER ID (extra money)

 

WHY SHOULDN'T IT BE 100% ACCURATE or the call never goes through

 

DID I ASK or TELL YOU TO CALL???

Okay, question, while I applaud the states for inacting such legistlation, but if FDCRA states it's against the law for CA to spoof their numbers, what's the purpose of State laws?

 

Or would this just be "added protection" In addition to Federal?

Federal courts don't like penny ante FDCPA claims and federal court is extremely regimented in terms of how things have to happen ... a difficult place to be a nonlawyer litigant.

 

State courts are often chary of enforcing federal laws even when they have jurisdiction.

 

Going to state court with a state law claim can be a much more comfortable experience.

I ALWAYS photograph my caller id. In fact, I just sent my lawyer 4 pics the other day from a CA who is using an disconnected phone number in a different state to show on caller id--also called during the validation period AFTER receiving my letter and has not responded. :rolleyes:

 

I hope my state adopts this law soon. The best I can see is an FDCPAviolation and possibly an FCC one I think--using a false business name or something long those lines.

Many many moons ago...THERE WAS A SUCH A THING AS OUT-GOING CALLS ONLY PHONE NUMBER

 

They could never get any ingoing phone calls on that number

 

It was mostly for telephone sales calls

 

Not saying that they have this product...seems like a lot of WORK to make collection phone calls (SPOOFED)

 

All they would have to do use use a phone card (LIKE AT&T PHONE CARDS) or a cheap cellphone with no way to track the user

Ya, it's just that the caller id states a state (for the name) and then that phone number. These people are not located in that state.

 

Either way, I like the part about this law allowing up to $5000 for damages :angry: Sounds good to me.... lol.
