At least a year ago, I sent both Asset and Pentagroup "I don't know anything about this debt, only contact me via mail" letters about different alleged debts and they received them because I got the green cards back. They never acknowledged in writing that they received my letter, only continued to send out the monthly printout letter of "we haven't heard from you, pay up" Didn't hear anything from Pentagroup for the longest time, and a letter every three months or so from Asset. Now in the past two months Asset has been calling almost daily on my home phone, but only rarely leaves the recorded message to call them back (yes, I'm storing the "AAC" calls in my caller ID). This week, Pentagroup has started calling my cell phone - drat! - and leaving no message. I called them back (with my blocked number home phone) to see who it was, and the first time someone picked up, burped loudly into the phone and hung up (ahhh, what a professional!). I called a few hours later I suppose after they'd gone home and got the Pentagroup recording. Are they violating if they say nothing?

 

P.S. Separate issue - When does a paid collection drop off my reports (in California) and when its time, how do I properly nudge the CRAs to delete it? I have a tiny paid SBC collection from '99 on my reports.

I think the violation is calling your cellphone. Try the TCPA and see if that's the law that applies. As far as calling and hanging up - I believe that would be considered harrassment under the FDCPA.

 

I'm really not up on the most effective way to stop them, unless you want to take them to court - that's a lot of trouble when you can change the number, unless you're looking for a reason to sue them anyway.
