Maryland Lemon Law

 

If the defect substantially impairs the use and market value of the motor vehicle to the consumer after a reasonable number of repair attempts, the manufacturer must, at the option of the consumer, replace the vehicle with a comparable vehicle acceptable to the consumer or accept return of the motor vehicle and refund to the consumer the full purchase price including all license fees, registration fees, and similar governmental charges less a reasonable allowance for the use of the vehicle (not to exceed 15% of the purchase price). There is a presumption that a reasonable number or repair attempts have occurred if during the warranty period: (1) the vehicle is out of service for repair of one or more defects for a cumulative total of thirty days; (2) a single defect is not corrected after a total of four repair attempts; (3) a defect resulting in failure of the braking or steering system has been subject to the same repair at least once, the manufacture has been notified and given the opportunity to cure the defect and the repair does not bring the vehicle into compliance with the motor vehicle safety inspection laws of the State. The consumer MUST NOTIFY THE MANUFACTURER IN WRITING, be certified mail (return receipt requested) and provide an opportunity for the manufacturer or factory branch or its agent to cure the defect.
