Alabama Lemon Law

 

The Lemon Law covers self-propelled motor vehicles intended primarily for use on public highways. It doesn’t apply to motor homes or any vehicle having a GVWR of 10,000 or more. The coverage period ends one year after the date of the original delivery of a vehicle to a consumer of the first 12,000 miles of operation; whichever occurs earlier. The consumer is required to give written notice of a nonconforming condition by certified U.S. Mail to the manufacturer and the manufacturer must be given a final opportunity to cure the nonconformity. A manufacturer unable to conform a vehicle to the express warranty must, at the option of the consumer, replace the vehicle or accept return of the vehicle and refund the consumer the full contract price, including all collateral charges, finance charges and the reasonable cost of alternative transportation during the period the consumer is without transportation, less a reasonable allowance for use. A presumption that a reasonable number of repair attempts have been made arises if, during the period of 24 months after deliver or 24,000 miles, the same nonconformity has been subject to repair three or more times, or if the vehicle has been out of service (including the final repair attempt), for a cumulative total of thirty calendar days, unless such repairs couldn’t be performed due to conditions beyond control of the manufacturer, its agents, or authorized dealers.
