Question on next step(s):

  • DV letter to CA sent via CMRRR. - no validation within the 30 days of the CMRRR 11.17.2011 signature date.
  • Disputed with all 3 CRAs:
  • Rec'd response back from TU that dispute was completed and verified on 11.30.2011.
  • Rec'd response back from EX on 11.29.2011 stating they would be contacting the CA to verify the information.
  • No response rec'd back from EQ.

Do I now need to submit ITS letter due to (currently) 2 violations, or do I need to wait to see what EX and EQ responses are before filing the ITS?

 

Background Intel - this is a very small collection account ($115) that I didn't know existed until I applied for credit - and the bank told me I had a collection on my credit report. I had received nothing in the mail, no phone calls etc.

 

Any guidance / assistance would be greatly appreciated.

Who is the CA?

 

What type of alleged debt is this?

 

Are they bonded as required under the TFC392?

  • Yes, TFC392 was cited in my dispute letter to both the CA, and the CRAs

Who is the CA?

 

  • Midland Credit Managment

What type of alleged debt is this?

 

  • Collection Account, with original creditor listed as T-Mobile.

Are they bonded as required under the TFC392?

 

  • Yes, they are bonded (RLI Insurance Company Bond #CMS205664)

Adding to my responses

Wait until the CRA's finish their dispute.

 

  • As of today I have one CRA left remaining for the dispute (Equifax).
  • EX: validation completed and the amount owing changed to $114 - still listed as Installment account, with pay status 'collection account'
  • TU: validation completed and the amount owing changed to $114 - still listed as Factoring Company account with pay status 'in collection'

Definitely wait to hear back from all three - each verification with THEM and none with you is an additional violation from what I understand. I just finished my ITS and draft complaint last night for a Shreveport, LA company that apparantly doesnt take TX law seriously - they didnt respond to me either.

You need to give them the full 30 days then add 5 for mail time before shooting off your ITS and Draft Complaint. I have midland on my report too but havent started that fight yet - I picked about 8 or 9 and am still working through them - so far I'm 3/3 on draft complaints and still waiting to hear from a couple, plus a couple of accounts just folded with the initial DV letter. It's tough but stick with it.

CPREMS and ASHLIA are both full of great tips for TX issues.

update? you send the ITS and draft complaint?

 

Update: No need to send ITS letter - they dropped the collection from my credit reports. I have the file just in case for some reason they show back up again.

 

I have another (now that I've been approved for FHA loan that I've received a letter on - so I will be starting the process all over again for this collection company (student loan debt I'm currently paying on and my account is in good standing!)

Background: I live in Texas, and I had an invalid debt on my EQ and EX credit reports from Afni that I wanted Afni to validate or remove.

 

I sent a debt validation letter CMRRR to Afni on April 16 referencing TFC 392 and giving them 30 days to reply. They received it over 30 days ago.

(the letter also referenced BCC17 with 60 day notice)

 

I have not communicated with EQ or EX about this item yet.

 

Results:

1. I haven't heard back from Afni

2. When I next checked my EX credit report on May 7, the Afni item was gone.

3. The Afni item is still on my EQ report.

 

Is the best next step to send a letter to EQ notifying them to remove the Afni item because Afni didn't reply?

No, the CRA's won't care in the slightest. Send an ITS letter to AFNI. Also, it would be best to put your questions in your own thread in the future. It is less confusing for those answering. If OP comes back, and adds to this thread, we'd be trying to answer two different sets of questions in the same thread. In the future, just start your own thread, and include Texas in the topic.
