@hdporter My bad. The info in bold is what I was trying to convey. I included the information about the $0 balance because I knew some members were going to think the card is reporting a high utilization rate. Sorry :)

The other thing is: over the past few weeks, I have been talking to few members here and they knew I just opened up few new TLs, including the Apple CC. So I mistakingly assumed everyone knew what I was talking about.

Believe it or not, I had an express card before. Defaulted in 2016 at the start of my "Great Depression". They sent it to JHP, which was reporting for awhile by itself. Comenity removed the original TL in 2016. Sometimes in 2020, JHP also disappeared. I never wrote them a letter or complained or anything. As far as I am concerned, they're very nice people. 😂

They may still have those memories in their internal files and hold them against you.

Has the credit reporting time period passed?  If so, sue the turds!  Get an easy $2,500 out of them.

Yes. Also they did not send a dunning letter. This is a JDB BTW.

Looks like you have a FDCPA and a FCRA violation.  I forget what statutory damages are, but you might have an easy $5k.

 

Only one slight problem, though, is that the jury is still out on whether JDB's fall under the FDCPA.  OC's do not and CAs definitely do.  I don't think there has been any definitive verdict on JDBs.  JDBs do, though, "voluntarily" comply, probably because they don't want the issue to reach the courts.  

 

If you are in California, however, their version of the FDCPA, the Rosenthal Fair Debt Collection Practices Act, definitely does cover OCs, CAs and JDBs.

Oct 2026 was the first delinquency on the OC account. So I guess they are still within the 7 years rule.

Indeed typo. it was  Oct 2015. So 2 more months. The are asking for 1,300 up from an original 1000 debt.

 

It appears they have violate "Regulation F"  by not sending a dunning letter or making initial contact though?

I would dispute it with all the CRAs.  With only two months to go, they would all deleted it as obsolete even though a month or two early.

 

Then I would directly tell the CA / JDB to SMD and to FOAD.  They are prohibited from future contact after that.  If they threaten legal action, good.  The SOL has surely run and threatening an action they are not legally allowed to take will get you $2,500.

 

I do not know anything about Reg. F.  Perhaps you are correct.
