I have proof that my debt is invalid. Doesnt sound like they want to drop it and may send me to collections. Can I sue for damages / harassment / false credit reporting etc.?

Sorry, I live in but Im not from the US first of all. Currently in AZ

A gym that you can visit Any Time and their partnered financial solutions is trying to collect a $211 fee for a $50 payment that I have proof which I paid. I also have proof of cancellation and proof of them receiving my cancellation via email. ive asked for debt validation 3 times with no response. I have a paper trail of everything

I dont want this impacting my credit score and I also want to explore the option of a payday here. Can I sue if they try to send this debt collections?

And yes, I have absolute concrete proof that I paid.

Welcome to Creditboards!

We hope that you find what you're looking for here.

Some helpful tips:

  • Your post may not get a reply right away. Don't be discouraged, this is a very busy board. If it falls off of the first page, feel free to reply to your post yourself, with the word *bump* in the text. This will *bump* your post back up to the top of the board.
  • If you haven't yet, take a peek at out Newbies Section. Everything that you need to know is in that forum, for the most part. It's a lot of reading, we know, but this credit stuff can have a steep learning curve. In no time, you'll be posting like the pros!
  • If you find that someone is discourteous to you, use the REPORT button at the top right of every post - that will ensure that a moderator or admin looks at the post and decides if it is against the TOS.
  • Off -topic posts should go in the General Forum.

Again, welcome to the CreditBoards family!

Are you using a tailored letter specific to YOUR set of circumstances or are you using generic cut-n-paste tripe?

Who did you send the letter to?  Have you actually gone into the fitness center to speak with a member of management?  If not, why not?  If this is a local place, then the EASIEST thing to do would be to have taken your proof of payment into the local facility and discussed it with them...
